Mercruiser Alpha drive Warranty

Anyone know how mercruiser warranty works?
Tore up a drive last year. Insurance company wanted to replace it with a rebuilt. The guy that did the work suggested I wait until last fall to get a genuine mercruiser drive when they go sale.
That's what we did. I bought a genuine mercruiser drive and it was installed last year in January. I have since moved 400 miles south and found drive oil in the bilge on the port side. Took it into a local shop and they found an internal seal torn somewhere in the upper case causing the leak. Should this be a mercruiser warranty issue?
