thanks for the replies, and yes I too think that it's buyer beware when it comes to condition. but, the year is the most important factor in determining value. a2007 bayliner is only worth what they sell for on the day it's sold------every year less!

The first and most important issue is did the boat get paid off and if yes was a pay off authorization letter atached that gave Key Bank instructions on who and where to send the title.Did you get a power of attorney signed so you can sighn the title on his behalf? If not and in fact you do get the title, you'll be driving back to have him sighn the title.
Did you check if the vessel is Documented, its probably a goog idea ? Get that signed too if that applies.
If he advertised it as a certian year I would think you would have a cause of action against the seller,in the state and county that he resides in.I would go to the County court house and File a Suit in the Special Cival, you can do it pro-se and I think being a corporation he cant answer the complaint himself and has to hire an Attorney.If he doesnt answer the complaint you should get a default judgement and if the boat was owned by his company the judgment should attach the assets of the business. I'm NOT an attorney and this is NOT legal advise, Just what I would do.Good luck

Thanks for the reply, the up date on the situation is---- I got a hold of key bank and yes they have been paid, what a relief. new problem, what they did was a paper less trans action and there is no title. they notify cal dmv and then the dmv creates a title. then it is sent to the address of the reg. owner, he then send it to me could be six more months down the road! to anyone who reads this never never never buy a boat that has a loan against it. no title in hand no deal!!!!!

I would have to say that many used boat purchases involve paying off a load by the owner. I would imagine that less than 20 percent of the people on OSO own their boat with no loan. Unless I missed it, you never said the amount of the transaction but if NADA indicates that it lost $6500 in one year, then it's probably about a $100K boat? To say "never buy a used boat from a buyer with a loan" is silly. You've probably wacked off more than 80% of your choices on the market. Use a middle person......my two cents!

Thanks for the advise, but the buyer is the only one taking a risk! there are so many different scenario that puts you in a risky situation so you have to make a judgment and hope what the guy is saying is true
