How can they do that? A marina is a private business unless it is like Farley Marina @ Trump Atlantic City which is a "State" marina.

I puzzles me as well...but they're doing it....

I spoke to the marina owner today and he thinks that because our marina has a restaurant (open to the public) that we might be ok... BUT they will still need to provide a "walkway" for the public to gain access to the waterfront...

There is a funny little catch they makes the state of NJ have the power to designate certain rules.
1) A Full Operating Marina with docks with public facilities has to have open slips for transient in an emergency situation anyone has the right to dock for 24 hour period and the Marina can not refuse.
2) Anyone can fish, crab or hangout on your docks and have use to your public bathrooms.
The funny thing is if any person gets hurt on your proberty it won't be the state that gets suied its the Marina.
There will be a couple of catches a private marina considered a boat club, sailboat club and Yacht Club are not effected by this.
If this goes through I bet you will see a lot of Marinas changing over to some kind of private boating community.

We don't have to worry were not a Public Marina we don't have bathrooms open to the public

Our bathrooms are locked with a code key and I hope it stays that way.... I don't need no heroin addicts leaving dirty needles on the floor. We have enough problems with drunk boat owners making a muck of the place....

I think there is a bill in the Assembly to modify that rule. I will check on Tuesday.

Ya know they tried this public access for the beaches. There are still beach badges . Don't think it could happen. There would be some loophole. It still dosen't stop me from walking down the dock and pissing on the side of the apache when I forget the bathroom code. You surfers started all this access rights mumbo jumbo anyway.
