Somebody stole my name
Finally getting around to starting a Nelems Marine website( I'm a slow learner) and I find out some jerk registered nelemsmarine.com with the idea of selling it to me.nelemsmarine.net is available but I figure .com is where most people would try first.I'm new to this,do I get my attorney on this guy? There is only one Nelems Marine in the world, he has no marine connection or any connection to me whatsoever,he's just trying to make a buck off of me. Or do I just go with .net?

Ask your attorney, But I don't think you have a case.
Anyone can buy any domain name as long as someone hasn't already bought it. It doesn't matter if it's a registered business or a trademark. Doamin names are wide open.
Back when the ".com" frenzy started people were quickly buying up all the names of major companies hopping to make big bucks in selling the name back to them and they did.
What they would do is, they'd buy all possible forms of the company name. Like Pepsi.com, PepsiCola.com, PepsiCo.com, etc. so they would have no choice but to make a deal.
This guy probably found you didn't have one registered and bought it on speculation. Even though he has no intention of ever using it, I think he still has to pay an annual fee to keep it.

I contacted him a long time ago,he woud not price it,he said make an offer.I thought about offering to send a couple of my Alabama buddies over there and break his legs but I didn't. I wouldn't pay a penny for my own name,thought when it expired he wouln't renew it but he did. It comes up for renewal again in a few months. Guess I'll see if he renews it again.

welcome to internet slime, everyone should watch out for this as well as once you have a domain name and you lapse in payments some slime can bye it like backtaxes and take over usually turn them into porn sites. how boat nelemsmarina.com?
I not for gov't intrusion but this should be regulated, this as also happened to big companies and movie stars.

I do not think .net is to far off, I have seen alot of new websites lately with .net instead of .com. I believe Checkmate had to use
.net, do to the same thing.

I would first make him an offer of $35 buck. Just to get his reply.
Then if he asks more than $100 for it, forget it.

Don't pay this jackal a penny!!! If you are the only Nelems Marine then absolutely no one else will buy the rights. Why would they? Let him continue paying the annual fee ad-infinitum if he likes it so much. Nelemsmarine.net sounds great to me!!!
