It's very likely the time to save the boat had past(he really should have turned around sooner, but this is easy for me to say ...now). His situational awareness and ability to tell if that wave was going to break on him or not is something we don't know. If he was sure that wave was not going to break, a little slower and a bit of angle might have helped and made it possible to ride down the back of that wave. The wave did not break, but if it had and he was going slower I think it would have been worse for them. I'd be crapping my pants if that was my boat and I'd have gotten myself into that.
It's a shame, that was a very nice boat.

this is what I said in the first thread.
I asked the question. does not mean i think it will happen. but let face it.
a you-tube video that cant show the vessel number, or the registration is just that a you tube video.
legally they cant prove he was the one in the video.
also on the insurance comment. just cause you do something stupid does not mean they don't cover you.... people drink and drive. and insurance still has there back. that's why once you get one you pay our your ass, same with tickets. this guy was at the wrong place at the wrong time, but accidents happen.
also he made it back to the dock, so again how you going to prove its HIS BLACK 43 DONZI that was in that video? granted we all know, and they will know. but in court its what you can PROVE. that goes for insurance, and warranty's.
its not against the warranty to take int he ocean is it?, or go over a wave? do they nomericly limit the size of seas the boat is covered? if so , again how you PROVE this was the boat in the video, and not someone else? unless he has hospital bills, tow bills Ect from the same time period/ place. but still does not PROVE with out a doubt it was THAT boat in the pic. with out the proof the video is through out of court is admissible evidence. and thus you have a boat, that was in the ocean and broke in half...
just playing a little devils advocate/
