That's really splitting some fine hairs Griff. You can dispute that all day in court if admissible evidence was at stake. For all intense purpose, in N.Y., you are not under arrest until the officer udders the words "you are under arrest".

Griff, if the subject is not told he/she is under arrest, he/she is not under arrest.
