Default NY Lawsuit Update

Last Friday, June 27, the Friends of APBA appeared before Judge Makowski in Erie Co., NY, for argument on three issues: (1) who shall serve as the interim (until the suit is resolved) APBA BOD; (2) should the Fall 2002 election for Board members be set aside (a motion to dismiss filed by Respondents was also considered as part of this issue) and (3) the issue of the contempt citation against M.Allweiss. The Court has taken all matters under advisement (ie: not yet ruled) but has indicated that he will be meeting with the attorneys for both sides today, Monday, June 30.

Present in Court were:

Petitioners: Charles Strang, Mark Wheeler, Robin Shane, Edward Hearn, Don Allen, Steve Hearn and Fred Hauenstein.

Respondents: None

Others Present (besides the lawyers): Ms. Gloria Urbin, Mr. Stan Fitts, Mr. Stew Shane, Mr. Lee Mills.

Argument lasted approximately 2 hours. --14-H (Ed Hearn).

Side note: Wheeler, Allen and E. Hearn arrived in DePue, IL for the SO Central Divisionals at 6:00am local time on Saturday. What a trip???!!!

Default Correction

Oops! Steve Hearn is not a Petitioner. He's an "others present". 14-H.

Default Judge will rule on Wednesday

The Judge informed the Parties on Monday afternoon that he had not yet ruled but expected to rule by Wednesday. 14-H.
