The arguments against a "No Spam" list are BULL$HIT!
If we can pass a law that says you cannot send drugs into the USA, you can pass a law that says you cannot send E-Mails into this country. Lack of knowledge that the drugs are destined for the USA is not a defense -- Why should spam be any different.

Ah, that would explain the drug-free streets of America's cities...
And tracking electrons is a helluva lot more difficult and time-consuming than tracking down 400 kilos of coke or a couple tons of marijuana.
