yellowbird, belive it or not call johnny cochran. here in new orleans a few months back the convention center wanted to expand and a wharehouse that 2 people turned into a art studio/gallery/ home, stood in developments way. well the city wanted to give them pennies on the dollar. they wouldn't budge and hired cochran. he got a few mill for them. no bullchit.

If I am not mistaken, in order for emminant (sp?) domain to be used, the city has to show how it will improve the area to benefit the community at-large. It is also my understanding, and I may be wrong, that it cannot be used for private purposes. So, if the city is trying to take it by ED, and then turns the property over to a private develop developer, I BELIEVE that falls outside the constraints of the statute.
