Thumbs down APBA vs. Offshore LLC Settlement?????

Last Friday, the interm Board of Directors of the APBA approved a settlement agreement between the Friends of the APBA and Offshore LLC that also resolved all disputes between the APBA and the LLC. This settlement agreement had been arrived at by both sides over the past few weeks. The vote by the interim BOD was unanimous to approve, however, Mr. Allweiss was absent from the meeting. Today (Tuesday, 9/30), attorneys for both sides appeared in Court in New York in order to place the settlement on the record. The Attorney for the Respondents (Allweiss, Jones, Jacobsen, et al.) refused to approve the settlement on the record before the Court and made additional outrageous demands never discussed before. BOTTOM LINE: Allweiss & Co., are now unwilling to abide by the settlement agreement struck. Okay, now shut up and race! 14-H.

Not exactly an unbiased "perception" of what happened...... I'll wait for more facts before I state a position on this whole mess.

Who's attorney handled preparing the final version of the settlement document?

Usually documents like that are written by one sides attorney and forwarded to and approved by the opposition prior to court.

Just yesterday, I was in the middle of a real estate closing where the closing documents did not coincide with the final agreed upon contract. The attorney reviewed a modified contract, and signed off on it - but it was not the one that was sent to the closing attorney.

Disclaimer - I am not implying that is the case with APBA.
