Give him his money back. No harm, no foul. Move forward.

I was interested in a boat they had and experienced a similar situation and felt very uncomfortable with how things were communicated so I never pursued the deal. I have provided deposits in the past but always had a signed agreed contract up front and how the deposit would be handled. |

Maybe Legend Marine should become a Pantera dealer with tactics like this! :D |
I took a 5k deposit on my Fountain last year and gave the guy his deposit back , even though he didn't come clean and played possum hiding for over two weeks when funding wasn't available .
We had no contract , just a handshake . This action will cost Legend Marine many future sales , our fraternity has far reaching tentacles of communication . Perhaps they are on the outs in which case if you do a deal make damn sure you walk out with unencumbered title in hand . IN HAND , not a photocopy with a promise of express mail . Based on this thread I personally would be afraid to wire these guys two cents no matter what they represent . Hopefully they'll rectify this matter and prove my assumptions to be incorrect . |
I've been on both sides of this arguement. But either way, a deposit is non-refundable. If you're not 100% sure you want something, don't put money on it. The whole idea after all of a deposit is to take the item off the market showing the buyer is commited and the dealer is not wasting its time. However if the buyer commits to 5k sight unseen, thats just crazy. Then again so is the fact they wont return contact.

One side
There has only been one side of this story communicated. I highly doubt someone has reputable as Legend would be "shady" about anything. It's not their first boat sale or "no show" customer.
|
So how many of you guys saying " give the $ back" would shell out 5 k with no plan on picking up the boat or a contract???
|
I'm saying in there live of business the 5k is not worth losing a future customer.....it takes 15 happy customers to get one.... It only takes one to lose 15. I do boat interiors I ran in to a guy that I did his complete boat 2 seasons ago. When I asked how the boat was doing he told me that a piece on his fountain was ripped. The next thing out of his mouth was its nothing you did. I should keep a better eye on people walk on the boat it's in a spot the gets steeped on all the time. Now I can promise you the only way this is going to cost that man a dime is if I do not have enuf left over material from his boat to fix it... And if I don't it will be done for him with no labor cost and he will get my cost on materials. Do I have to do that .... No. But he did a complete with me 2 years ago and it's my name on that job. When he is sitting out on the lake with his friends and subject of interiors comes up my name will be brought up right away. So to me it worth 10x more to make a customer happy and lose a little bit. And in my eyes that's how business should be done. There are a lot of sharks in this industry trying to scam every last buck out of every boater out there. I can't beleave that anyone thinks its ok to keep 5k for holding a boat for 24 hours. When the deal in 100k+ deals all the time... If this makes them to lose 1 sale it's not worth it.
|
And I have another question... Do they own the boat or is it on consignment? If its on consignment did the give the owner $4500 of that 5k.... are they scamming both people?
