Danyelle Lieneck — the courageous 13-year-old Long Island girl who heroically struggled to save her dying sister during a tragic boating accident — has told her family that the man she saw on television under arrest in the incident was not the same man she saw behind the wheel of the other craft, The Post has learned.

A lawyer for the victims' family has reported the claim to the Suffolk District Attorney's Office and Homicide Squad detectives are investigating the report.

A family spokesman has said they want independent proof that boating-while-intoxicated suspect Steven Fleischer, 33, was actually piloting the boat instead of one of his allegedly drunken friends.

"That's not the guy who was driving the boat," Danyelle told her family, as she saw TV footage of Fleischer.

"It wasn't him," said Danyelle, who, during the emergency, bandaged her mother's gashed arm, called for help on the boat's radio and administered CPR to her dying sister Brianna, 11.



"We didn't let her watch any TV until last night," said her uncle, Tom Costas. "This was the first time that she saw the guy who was arrested."

"She said it wasn't the guy in the 'U.S.A.' shirt," which air traffic controller and BWI suspect Fleischer was wearing, said Danyelle's aunt, Sandy Costas.

Mrs. Costas said her niece remembers seeing the man wearing the 'U.S.A.' shirt at the scene of the crash Wednesday night at 9:15 in the Great South Bay — but not at the wheel.

Family lawyer Scott Zerner, a former Suffolk prosecutor, confirmed yesterday he had "let the authorities know that they need to speak to Danyelle as soon as possible. They need to speak to her before the day is out."

Police and the Suffolk DA's office "are doing everything they possibly can" and the family is waiting for them "to complete a full and comprehensive investigation," Zerner said.

Investigators could not be reached yesterday and Fleischer's lawyer did not return a call for comment.

Fleischer refused a Breathalyzer test after the accident and police obtained a warrant for a blood sample to determine his sobriety.

Felony charges against Fleischer were reduced Thursday, after a prosecutor told a judge the test showed no alcohol in his bloodstream.

Sources said Fleischer actually had a trace amount of booze — .003 percent — almost four hours after the crash that critically injured Brianna Lieneck's father Frank and mother Gina, both of whom suffered severe head injuries.

Both parents have been told Brianna is dead and are in a nightmare of "physical and emotional" agony, said one family member. Gina Lieneck sobs from her Southside Hospital bed in Bay Shore, "Why? Why? Why? Why did I lose my baby?"

Her husband Frank falls in and out of consciousness, family members and friends said.

I sure hope they can get to the bottom of this mess....
They need to knab the correct person!!!! But now if this is true they'll get them both.

I said it on the other thread, you don not go from and intoxicated state to a 0% Bac in four hours ............ If she did not see what she did, he would have beat the rap in court. I hope she ID's the S.O.B. that was driving the boat !!!!!!!!!!!!!!

If it wasnt the owner operating the boat and she id's the driver he better hope he doesnt a named driver policy or all hells gonna break loose.
