Legal Advice Needed: Park One in South Florida

3 Attachment(s)
The valet service at our condo in Aventura is contracted to Park One, as most are in south Florida. When I returned to the Condo after the Key West trip on November 21, the valet took my keys(you can't park your own car) and I went upstairs. The next morning I went to get the truck and I was missing a fender. I went to the head valet which was not on duty the night before(and is a nice guy), and he knew nothing about it. The guy that parked it wrecked it, and threw the fiberglass and lights in the trash to hide it like it never happened. There was a security camera 10 feet away that got all of this on film  There were 3 empty large parking spots where they usually park it, and this idiot tries to put it in the garage  The head valet could not believe this happened, and has been good through the whole thing, but he can't do anything to fix it. I have left his boss at the main office numerous messages and still no response after 2 weeks:hothead: Should I have a Florida attorney call the boss? I think he was doing a little more than the 5MPH on the sign, but this is the wall that he hit, and the truck :( :(

its a gm product.. i think its an improvement.... that sucks, for that reason i let no one park my truck, if they dont like it they can kiss my ass.. sorry to hear bubba.. you still suck though...

I assume that you obtained a few estimates for the repair cost already, and got a copy of the video showing him doing it ?

Where is Park One located ? If close by, I'd first try and drive over to their corp headquarters in the truck with the estimates and video and explain to the 'head mofo' you have proof and want this taken care of.

If not close by, maybe your attrny can just make a quick ( cheap ? ) call to the head mofo explaining the proof and backup support from the head valet at your complex.

WP36,

Get me a copy of the video and I'll send them a "NASTY LETTER" at no cost to you, pro bono. This kind of chit burns me up as I've been in the same position as you. PM me when you have the information.

Mystic Pointe security has a copy of the video, and I am not sure if I can get a copy. They have not denied it is their fault, I think they are hopeing that I will just let this go away  I will call my condo assoc. tomorrow and see if I can get a copy of the video.

Thank You Donz :D

Re: Legal Advice Needed: Park One in South Florida

Demand that the video not be destroyed or erased, via certified mail, and fax (TODAY)...let them know if they do, they may be liable for spoliation of evidence....that is key evidence.

That sux!!!!
But you know what? It happens more often that you may think. Valet drivers generally aren't used to handling big trucks like yours and forget that the fenders and tires stick out. I've seen it happen more than once.

Get a lawyer, then go fight.
Good luck.

Contact YOUR ins. co. and work with them to get your truck fixed. Let them know that a valet did this working for Park One and that their is video proof of what happened to the truck. They have more vested in you to make sure your happy and have people working for them to deal with this kinda stuff. (I dealt with something similar 2 years ago and after 2 weeks I just let my Ins handle it. Several months later I was notified everything was taken care of.)

What a pain!

I agree with getting in touch with your insurance company. They've got a team of lawyers that deal with this kind of stuff all the time. The last thing they want to do is pay to replace your fender. If anyone can collect on these guys, they can.

Don't let it get you down. Things will work out. Good luck!

Go after the company they must have liability insurance.

Personnaly for the guy parking it, it's not worth chasing your recourse is against his employers. Or, You could take him to Key West and feed him 15 Smoothie's 190 with a shot...

BTW why the fack do you carry your dock floats in the back of your duallie? Didn't you know they have some in Florida? :D:D:D

You also need to send them a bill for your time dealing with this issue. They caused you to deal with this, they pay for it.

The bossman from Park One finally called and admitted fault  I am faxing him an estimate, and he says they will send me a check  I didn't ask him why he ignored me for the first 16 days, or I may have never seen a check.

Thanks for the input, and if I don't get the check we'll unleash the power of OSO on him :evilb:

Park One sucks! I personally have 2 friends whose cars they have crashed into somethign while parking and then denied it. I also have an attorney friend who is respresenting them in multiple cases. He said the best thing you can do to defend against this is, check your vehicle throughly when t hey bring it back to you, if there is damage DO NOT LEAVE, call the police and get a report, then you've documented it.

Re: Legal Advice Needed: Park One in South Florida

Sorry to hear that Bubba.

When my brother ran a valet co., they were instructed to ignore the calls and letters. Most do not have insurance. The valet company has nothing to sue.

My brother said that they would pay when their customer (restaurant or condo) would threaten to fire them if they did not pay. So focus hard on the condo association you belong to. Most people give up the chase and go to their insurance to pay for the damage. The insurance companies give up chasing when the attorney costs exceed the damage.

Mark, that is exactly what happened. Our condo assoc. said if Park One doesn't take care of it, they will find another company.

I valet parked on South Beach one night and ended up getting a parking ticket in the mail a month later. The stupid valet illegally parked the car and I was stuck with the ticket. No way to prove they did it.

I hate valet parking.

Get a copy of the video and make sure you have a police report. They are responsible, it will just be hard to get any money out of them.

Good Luck.

I travel to LA alot with my Excursion and love valet parking because most Hotels do not have big enough garages to park it in. So most of the time they leave it up front near the entrance. After this thread I'm having second thoughts about valet parking!!!! :evilb:
