Another strange boat & money story
 

We just dodged the bullet on a 70' catamaran mid last year. Deal was new construction. $350k boat. 25% down 25% at the 1/2 way mark. Balance due upon completion. First 2 payments OK boat gets finished customer goes "I ain't got no money but fess up the boat". Our lawyer draws up a contract we split ownership with customer he has 6 months to fess up the balance. If he doesn't make it the boat goes up for sale we get our $150k out first and he gets whats left. 6 months go by azzhole doesn't make a single payment. In the mean time his web site posts all the customers he takes out each day & what fish they catch. We filed for the repo. The look on ole boy's face was classic when he rolls up to the dock the court representative and our lawyer are there in suits behind them is me with a 250 lb coil of tow line over one shoulder and right next to his boat is this 80' foot commercial fishing boat. Court rep read him the papers told him to hand over the keys. We emptied everything that wasn't a part of the boat on to the dock last thing off was the rolls of toilet paper out of the heads. We towed the boat about 3 hrs down the coast to a marina. The court sealed and it sat there for about 5 weeks till azzhole fessed up ALL the cash. When it was all over we threw a little bash. The boss was still livid that ole boy completely blew us off for the whole 6 months. Then the lawyer told the boss it was a good thing the azzhole didn't make any payments because if he had the court might have put off the repo because azzhole showed "good faith". If he had made $100 a month payments every month the court might of said just let him pay it off. Just how long is it gonna take to pay off $150k at $100 a month........ Oh yeah since there was no interest in the contract there would be none paid....... Yup we dodged the bullet that time and huh oh yeah boss canned the lawyer and got a better one now:drink:

as for as "day counts" it was 3 days.....Nordic said ONE DAY, not me....it was ONE BUSINESS DAY....

So if business is business as Nordic might suggests in his claim to "one business day" the contract is legit in my eyes.... but my phone still rings on Saturdays and Sundays and my PM's work on the weekends too....3 days is 3 days...3 days is plenty of time to make different arrangements or work out a different time frame....

5-6 months is even enough time to pick up the phone, no matter how embarrassed you are and say hey something came up, can we work out something different here?....

Still havent heard from Prostock directly....$14k is allot of money, you guys are 100% right....but I'm not going to work out anything with anyone other than Prostock.....PERIOD....

Nordic has got to have a financial interest in this money or he would get out of the way and let the parties involved make contact and try and work through it.....Its a matter of principal...if Prostock wants to work out something let Prostock ask me himself.....

Correction, he inquired about full payment....didnt offer to pay it....he inquired... the PM didnt say "im sending payment in full today".... PM said "what if I pay the balance?" there is a huge difference in asking and telling....

Federal, Ebay, and IRS have nothing to do with a boat deal....but do as you wish...this is a civil case at best...

The difference between ethical business practices, and legal business practices have become a much wider chasm in recent years. Society has placed SO much emphasis on the almighty $$$$ we have lost sight of true worth and honor. There was a time when a Man's word was honorable and forthright. Set in stone. This is not saying there are not still honorable Men, there are. On this forum alone there are many. Dave Scott, Gino, the Gieco Team, just to name a few. These men have excelled in their professions\businesses. Any speculations on the avenue they would take in this little debacle????

Unfortunately there are times when ones judgement is clouded by the issue of that old $$$$$. Hopefully the issue here can be resolved in a manner equitable and ethically to both parties.

I applaud your comments since it’s very true.

None of us really knows the fact and events that has taken place. I personally talked to LDD and Anthony trying to resolve this, due to my personaal background in “Contracts” of all sorts and being familiar with business laws.
I tried to stay away from this, once I made my recommendations two both,, but I will interject a few more comments.
Whatever happened . happened.
IF it ends up in court. LDD may win or lose but he has another case. Character deformation/assassination (sp?) by all the trashing he got here. I’m not condoning, taking sides, agreeing or disagreeing with the comments.. you all entitled, but when it goes to court.. anything associated with this issue will be relevant. E-bay.. Speaker boxes are relevant only for pattern, and character reference and it will be through out anyway.. It’s a contractual screw up by both. Integrity and what should LDD do or Prostock do. Is very subjective, and all the comments aren’t helping anyone. Even if it ends up as a court case. NO ONE WILL WINN, but the lawyers. Unless Nordic has “power of attorney” from Prostock dated back when Nordic got involved all his efforts (while it might have been to resolve the issue) may be helping LDD in the legal case. All the documented comment as “we” etc. will not help Prostock.
LDD should refund some of the funds. I don’t know ALL the facts and details so I can’t comment on the amount.
Here is my last suggestion to both. Pay attention and then all the rest can get on with better things.
I don’t know any one of them personally, I have no interest in this case. Just a boater seeing a lot of BS where as it can be resolved. What I have read is that Prostoc is relatively young, and LDD isn’t much older
(Prostoc 20’s ? .. LDD 30’s ?, no matter.

A) Prostoc has to contact LDD and resolve several things, his intend to get back to negotiations, or formally tell LDD that he is done and in the court it goes.
B) If Prostoc uncomfortable with negotiating and wants Nordics help he has to inform LDD that Nordic may and will speak in his behalf.
C) LDD. You have to talk to Prostoc in a civil manner. You rep is tarnished and you have to do some damage control. You got to change your manner how to post and reply to other posts, even if they are against you are negative. The mannerism and harsh comments will undoubtedly get members pissed and everyone loose sight of the issue. Chill out. Be direct and professional No insults.
D) LDD!!.. don’t take a hard line of the contractual issues. You have some rights, and there is the right thing to do. Work it out. If it cost you additional money to get your transaction completed with the Fountain deal..? explain this to Prostoc. (for example,, if it cost you $ to get a loan , because the Prostoc funds did not get to you in time. Explain and be understanding to the situation. Prostoc needs to understand the other side as well. RESOLVE IT GUYS !!!!
E) Both have to take a step back and evaluate what’s important and right. Both has to put some arrogant feelings to the side and try to resolve this.
F) All the rest of “posters” need to stay out of the BS sessions, and let them resolve this or let THEM go to the legal channels. All the “opinions” and trashing of everyone and SOS.. VS OSO don’t mean beans. Grow up. !
G) I know many wants to help.. but.. may be an impartial arbitrator could get some enlightenment to both, out side of this posting war.

I’m not condoning what has been done, just suggesting to “GET IT DONE”

Mack, I agree but before my lawyers get fully involved (you know...the $200/hr phone calls), I'm seeing if this can get settled without making others richer, whether it be his or my money. At my $18/hr, it takes a while to make up lawyers fees.

Here is a thought. Someone start a poll,choices would be the amount LLD should refund,$14000,$12000,$5100,$0,or some other amount. Have both parties agree to abide by the results after it runs a certain # of days. No lawyers fees involved.The key to this is both sides would have to agree to abide by the results,and I doubt that would happen.

We already know the answer to that poll.

Somehow in his twisted mind he thinks he is doing the right thing. It's kind of the same mindset of people in jail. They somehow justify themselves into thinking they are right. You know everyone is innocent, they didn't do it.
