Lets get back on topic....

THE FACTS....

here are the FACTS...

Prostock agreed to pay $26,500 for the boat...see contract

Prostock sent me $14,000 deposit, we both acknowledge that..

Prostock NEVER sent remaining balance as agreed by the due date...

I ended up having to sell the boat on ebay for $17,600.00

As someone else suggest Prostock should be responsible for the losses and fees and I should not profit from the deal...the math is simple.... $17.6 + $14k = 31,600.00 recieved toward chris cat sale... $31,600 - $26,500 (agreed price) = $5100 Refund to Prostock...

I offered more than that to settle this, they refused....I'll wait for my day in court....and I havent lost a wink of sleep over the last 6 months that Prostock hasnt contacted me, HE STILL hasnt contacted me.....Just Nordic95....

Prostock has NO EXCUSE for not contacting me for the last 6 MONTHS......and has NO EXCUSE why he still hasnt contacted me...

The date of purchase of my Fountain has nothing to do with the sale of the Chris Cat. I purchased the Fountain before Prostock offered to buy the Cat.

Contract was written to MY time frame on when I had to pay my loan on the Fountain....Prostock agreed and signed the deal.

Prostock didnt pay by the date 6/13/08 (Friday) and didnt offer to pay the balance until 6/16/08 (Monday)..... It might be "one business day" but there was two days (Sat & Sun) he could have picked up the phone and say he needed to work out something different....by the time Monday rolled around other arrangements had been made...

Anthony, you too are withholding information to make me look like the bad guy....Like stating it was "ONE DAY" later I shut the door....In fact it was 3 days later and Prostock hastn called me since he sent the $12k....ALMOST 6 MONTHS AGO....

Now we are all in bad financial times 6 months after the deal and your on a witch hunt to prove something?....like I said I'll wait for my day in court...

For the rest of you bandwagon jumpers keep my wife, kids, inlaws, and personal situations out of this....it has nothing to do with this transaction.

P.S. If a court of law found in Prostocks favor, trust me I can stroke the check to cover it.....Its not the best time to write it, but I could do it if I absolutely had too...

This is 100% correct....the FACTS are posted!.....Nordic95 dug up what I sold the Chris Cat for on Ebay on page 7 of this thread....

The final payment was due on Friday 6/13/08, I didnt shoot down the offer to pay in full until Monday 6/16/08 when Prostock didnt contact me ALL WEEKEND to try and make different arrangements!....Yes it is "One Business Day" from Friday to Monday...BUT there was Saturday and Sunday that Prostock had ample time to call me and make a different arrangement!.....He never contacted me so I had to make other arrangments...as stated in the PM I sent to him....

Friday to Monday is 72 hours in which he could have called, PM'ed, or emailed to make different arrangments...He did NOT!

Bad faith indeed. At the end of the day, Dong's actions have alienated him from a community he so badly wants to be a part of. I hope it was worth it.

So why didn't you sell it on the 16th to a person with cash in hand versus running on ebay for tens days starting the 23rd? If I had someone put me in a money bind by having me hold a boat till they could get the money than yes I would be pissed about them yanking my chain and not following through but since you did not have a buyer in waiting and did not list is for sale for so long........makes it look like you were just trying to make more money. I think the right thing to do (ethics) is give the balance made above and beyond the asking price.

Actually, YOU opened the door on this one. Nordic95 said he was trying to resolve this behind the scenes when YOU started the first thread about this subject. Once you deleted the first thread, he started this one.

This is what I suspect was the math going on in LDD's head. He essentially got 14K + 17,600 for that boat = $31,600.

I felt for LDD at the start of the thread (being the seller, trying to get a deal done) but after seeing his posts, seeing how his mind works I suspect he took this kid for a ride.........
