Up here all the commercial traffic refer to them as WAFI's.
Wind Assisted Phucking Idiots. I'm sure these guys had the right of way too..

In some, if not all, parts of the world the ship that is working has right of way. Working boats (especially giant ones like tankers) usually follow are fairly consistant path. It's the legal obligation of the recreational boater to get out of their way and keep the shipping channels clear.
