Here is what I would do. Send me $5000 and the have somebody kick you square in the nuts, and then forget about the motor deal. Doing it this way will cost you less, you will have less pain, and the pain that you have will go away quicker than trying to file a lawsuit against this guy. In fact, I am feeling generous so I am having a 50% off sale, just send me $2500.

In all seriousness, it will cost you more in emotion and money than it is worth. Tough pill to swallow.

One lawyer asked another lawyer who wins in a lawsuit.

The lawyer gave him a stupid look because every one knows the answer to that question.

The answer is "Just Us", and that is how the word "Justice" was added to the English language.

I just made that up, however anyone that suggests litigation most likely has never been involved in litigation.

Take them to small claims court? Go for it, and get a defamation of character, tortuous interference, etc suit thrown at you.

The ONLY question you need to ask yourself is how much are you willing to spend vs how much are they willing to spend?

If you can out spend them, go for it.

I agree with most. even if you did win, which you won't IMO, you'd be lucky to break even with your time and lawyer bills.

Unfortunately, that's your best defense now. I know everyone wants to do things by themselves but if you had a certified tech from a shop with insurance do the change over as well as installation, that shops insurance would fight the engine builder for you.

Well, IMO, there is something wrong with the build. My reasoning behind that is Oil is not selective. Meaning, if it was starved for oil, you would have destroyed the entire motor, not just 2 bearings. As stated earlier, good luck trying to prove that, but anythings possible I guess.
