Do You Think A Jury Will Convict Me?
 
I am about to go postal trying to get my boat ready for the Emerald Coast Poker Run. Have had my boat moved to Mobile AL for a company to touch up some fiberglass, wash, compound, and detail the 1st week of June and was to be completed in 2 weeks. Well here we are the last day of July and they should have it ready Monday. I traveled 3 times in the past month 4 and half hours one way to inspect the boat and show them what a crap job they where doing. Now it has to go to the electronics store for all the other upgrades that could take 3 weeks. Looks like I'm screwed for the Poker Run and most of the season.

No replies needed I know what I did wrong, my point for the rant is when you are spending a large amount of money with these people get a contract and have a stipulation that if work is not completed on time there will be a monetary deduction until work is completed.

I guess I am too trusting but after all I have gone through and additional money paid I will not make this mistake again.

I hope I can make the last run of season.

Hang in there buddy. Frustrating now but should be worth it. Plus it's a long season down that way.

Thanks, just trying to pass on a little wisdom so the same thing might be prevented with someone else. These businesses need to be responsible for their actions.

I had an old college professor explain it simply : A Contract can be viewed as an Equilateral Triangle...one side being dollars, one being scope of work and one being time of completion. If any one side changes then the other two have to change to keep all parts equal.

Any agreement must contain clear language, agreement and understanding of all three basic elements. Without the 3: basic elements understood and agreed to...you end up with a "Cluster Fuk" LOL

We are getting off point a bit, it's not about money it's about people and businesses that don't do and preform the services they promise to provide. There seems to be a lack of work ethic today. From mechanics, truck drivers, and fill in the ________. I remember a time when your word and reputation was everything, and you didn't need an office full of lawyers and a contract to get you to do your job, just a handshake. Times are changing and they are not for the better. I owned a business for 17 years and sold it not because of the work but because the employees and people where such a pain to get them to do their job. It seems that people are lazy and feel entitled to get something for nothing.

I look at the younger people today and all I see is the movie "Idiocracy". If you have never seen it I recommend you do. No other movie is as scary as that one and it's supposed to be a comedy.

Two words my friend... "LIQUIDATED DAMAGES" which are assessed on a daily basis when you miss the agreed upon schedule without very valid cause.
This is quite common in my world, where we live and die by schedule & budget.

You need to suck it up as lesson learned and no need to get lawyer involved because will be waste of time also.
When you traveled three times to the shop to tell them what they was doing wrong and tell them how to do their job was the problem. A good lawyer will say reason for delay was you keep adding more stuff to do or if you wasn't happy with results you should have went else where. You should have let them do the job and argue payment option because you wasn't satisfied. Hate you going through it. just my 2cents

30 years in the biz, working under AIA contract building everything from Pharmaceutical Manufacturing, Medical & Surgical Centers, Food Manufacturing, Casinos, Churches, Jails, Prisons, Juvenile Correctional Facilities, Schools, office & multi use, student housing, you name it... the Food Manufacturing had the highest LD @$50k per HALF HOUR for any production time lost due to construction...

Along those lines I agree, I'd have yanked it out of there long ago. If the electronics is just stereo...who cares, motors sound better than music any day. If the electronics are integral to boating then get it there asap.

Regarding contracts...again who cares. All they do is involve lawyers, wrap up your boat in expensive litigation, and even in the event of a judgement good luck getting cash. The contract on this level is only as good as the parties signing them. If one or both have little integrity you're screwed anyway. Been there done that and all I did was contribute to my lawyers Porsche.

Remember back in college working construction, we had a few contracts where every week late it was a 10% discount off the agreed price. After a month it pretty much jumped to 50% off and only allowed to pay for materials at that point. Needless to say there was some motivation there.

Then again dropping a boat off between may and sep around here is a crap shoot, good luck getting back before the end of the season.

OK I can't let this go any longer, this post was to tell people to protect themselves by getting all expectations on a written contract for work to be performed. I do not need or have intentions of getting a lawyer, the work was ok but the hassles and, extra money, and time have all but killed my season. I still am pushing to go to Emerald coast poker run but it is not looking good.

I feel your pain, but I have grown to have a LOT of patience, and very little expectations. Almost never commit to a date. If you're like me, you will use this same boat next year, and many years to come so you want it to be done right. Sorry they're behind, but most of all sorry they aren't doing a good job, that would be my biggest complaint.

I won't let anything be released without it being a good job, that's why I had to make 3 trips to show them what needed to be done. It's now with the electronicsshop for the final leg of journey. It will be awesome when I'm finished, just about everything will be redone.
