I agree with orhers, operator error. You need to know the water you are operating in. At night you need to look at charts and know where hazards are. This is not jumping in a car and running down a paved road.
The government is not responsible to take away all hazards. How do you mark it that doesnt blend in with other lights. What happens when there is fog or rain,. Who is responsible if the lights fail.
The better course of action is to know the water way. Then use electronics to fill in what is hard to see. Every one should have a chart plotter and know how to use it. Radar is not the expensive. There are flir and low light cameras.

I love boating at night, in areas that I know well.. Once ran Lake Cumberland from the dam back to Burnside ramp on a moonless night. No electronics, and not a single nav marker in 30 winding miles. Sketchy as F.. But if you black out all lighting and focus on the task at hand, night navigation can still be accomplished safely at reasonable speeds. Add a bunch of lights onboard and along the shore line, my boats in idle mode...
I can certainly see that inlet being an issue if your blasting down the coast taking in the scenery late at night. However the latest plotters now do turn by turn navigation, likely mapping you around those end markers. So hopefully we'll see much less of this type tragedy as people upgrade equipment.
