This stuff is getting too close for comfort. That gas station is only a couple miles from my house and Ashland is not too far either.
I've seen people running serpentine paths to their cars.

Last labor day I spent 20 hours in a jail cell, 6x8 with 2 other smelly adults, 1 named Bubba (wondering where my boat was)was cuffed, finger printed, mug shots taken, went to court 4 times, hired a lawyer, spent $1,200 bucks missed 5 days of work. For a boating DUI that I gave blood and the results were 0.03 (0.10) is legaly drunk and all charges were pressed by state fish and game commision officers here in Phila.pa. The charges were Finaly dropped by a judge. NOT, The cops who arrested me. THey refused to drop the charges> BUT I was never arrested, I was told this when I tried to sue for harrassment.

Or you could just take our word for it since we both agree and he is a cop and I am a criminal defense attorney. (I promise we wouldn't agree unless we were absolutely certain! )

The inquiring minds can narrow it down to reading CA v Hodari D. and Florida v Bostic.

I was wonderin when you were going to chime in on this thread. Just figured I stir the pot a little

I stand corrected on my previously quoted statement and agree with you completely. Investigatory stops, Terry stops and Traffic stops do not apply and are not arrests, even though the person is not free to leave. They are "stops" or as you said "seizures" of an investigatory nature for a reasonable amount of time.

The only thing that bothers me about Troutly's post is it's dependence on the definition of "reasonable". Given the recent post "Death of Common Sense", it's probably only a matter of time before someone drives a bus through that potential loophole. Troutly - how may of the prople you have "seized" would you classify as "reasonable"?
