legal ?
My house sit's above the guys next door and with all the rain he is having septic problems. He came to me two days ago and asked if I would do something with my down spouts. I have a guy coming out tomorrow to trench in all my drains down to the bulk head. about 800 feet worth of trenching and pipe.
He just bought the place and is an old friend of my dad's. He just put a flag up on his boat house and has a flood light pointing at it, my guess about 500 watts. It is on 24/7 and light's up my house and I didn't spend the f-ing cash I did for waterfront property to put up black out shades in so I can sleep at night. I asked if he could put it on a timer or change the way it point's and he said that I should get drapes because he isn't doing anything with it. (He know's that I'm fixing the water problem.) What should I do my dad is dead so I can't have him talk to him. The way the light is mounted I can't just move it my self and hope they don't notice. He hasn't even stayed there yet, he bought the place as a weekend home and is doing a remodel on it so it's not like he has been dying over there. I want to put all my drains at the property line and tell him to kiss my a$$ but I don't know the laws. I would think my house passed insp. and it is up to him to put in French drains around his house. |
Shoot it out and make him replace it. When he gets tired of replacing bulbs he might get the idea.
Just an opinion and meant as an alternative. If he won't even consider helping you out why help him. The world is loaded with petty people pissing off those who try to do right. You coming out tomorrow?? |

If he doesn't want to help you, why help him. Use the money you were gonna spend on trenching and pipe for gas................or a nice new pellet gun. :)

1) Ask him again in writting to shade the light. Documant everything then go to the officials and lodge a complaint. There is probably an ordinance somewhere regarding it.
2) Forget the drainage system. It's his problem for having a house downhill. It's not your job to fix his problem. |
I would hold off on the drain work and then figure out the legalities of it. If he wants to be a prick then he will have a bad septic system. Besides, who says it is your runoff water causing the problems?
I would help him out as much as possible until he dicks you.....like he is with the light. Then....I would tellhim to pound salt. Figure out the legal stuff first though, you do not want to end up in court. But....wait on fixing the drainage Good luck. |
I wouldn't worry about 800 feet of trench for his sake if he can't move the light.
As far as him being a friend of your dads...your dads dead (sorry )but he's obviously no friend of yours. If your house has passed inspect. and is ok...."pluck him":rolleyes: |
I'm going to give him one more try in the morning when he sees the trencher here and if he wont do the light the way I want or atleast a way that it doesn't bother me then the only drains getting done are the ones that help me.
I shoot the seagulls of my dock all the time so I know I can hit the light but where it is if I miss or the bullet gos threw it's going to f up his boat house and I don't have the cash he does to fight him in court. I do well but he makes more in a month than I do all year. He has over 10 mil in boats 3 in different places all with crews waiting for him to show up. It's sick. I want to go get one of those big lights they use when the open up a store, the ones you can see 20 miles away and just poiunt it at his house the first day he stays there. Yes I'll be out this week end, I drove my boat to work today, it was sweet saw two boats on the way in and about 10 on the way home. I did have to slow down for two "LOG JAMS" I can't beleive how much crap is in the river north of Tims. Took about 1.5 hours off my best Friday drive home time. I think I'll be taking the boat every Friday the weather will let me. But it's not the best on gas used about 40 gal. today there and back. |

I like the light idea. My Uncle did that to his neighbor. They built a house ans pointed the spotlights right at his front door....he retaliated with some monster lights....they got the picture!! |

Too much anger
Ask him to pitch in for the trenching that you are doing to help him with his flooding and at the same time, ask him again to please put the light on a timer. If he refuses both offers, shoot the light out and tell him to get use to swimming in septic waste!!!!!

The laws in most states are universal when it comes to water: you cannot artificially divert water to you neighbors property. If the natural configuation of the land causes water to flow down to him and his property,he is SOL and without recourse against you. Conversely, if you were to install drains that opened up at the property line and they caused flooding in your neighbors property, you could then be liable. It sounds as if you are running the drains some distance away from both of your homes so that may not be an issue.
If you are installing the drains to help HIS problem, you have no obligation to do so. If you are having flooding issues in your homeand that is the reason for the remedial work, just be sure to have the drains placed away from his property. As for the spotlight, most jurisdictions have nuisance laws that may address the use of spot lights in residential areas. Most water front properties/communities have very specific zoning and use laws that may work in your favor. You may get a local inspector to cite the neighbor for the offending light. Otherwise, ask the old fart to turn the light off. If that does not work, go on to administrative remedies, and if you happen to slip, trip and fire a pellet gun at the light, they may work too. |
I always try to talk with my neighbors about things that I'm doing so to avoid any issues like this... What gets me is that they don't return the same courtesy... I'm dealing with a property line issue even though I had it surveyed and stakes put in the ground.... And I had him come out to see where the lines were and if he wanted to contest. No contest. He still refuses to stop expanding his lawn scalping techniques 6' over the line so his property looks larger. He built over the easment by several feet, however zoning says they can't make him move the house. What are the rules for??? Fine him or something. So I stopped playing nice neighbor and fight back by staying within the rules of my zoning. Try mowing over these big landscape rocks sucker!!! You can only be nice so long, some people only understand retaliation, only then will they decide to work with you.... You've done your neighborlly duties.... Screw the SOB.... I would take his concerns out of your decision making process and only do what you need for your place and I think your place needs a whole lot more temporary lighting.... I'd hold off on the drainage to satisfy him until he redirects that light.... Good luck...

We don't have any real "rules" or guide lines where I live, it's a private neighborhood with only about 50 houses most old and in need of a dozer. I'm the new kid (32) in town with the big new house. 80% of the other people have blue hair. I don't make hardly any noise yet and haven't even had my first party of any more than 15 people, I have only been here a year.
My drains that he has a problem with are pointed at his house but only because thats the side he is on they are 40 feet from the property line and 60 feet from his drain field. I knew I should have bought his house when I had the chance, just to knock it down and have a bigger yard. As far as the French drains the guy is here now and is going to start on the ones that will help me and not him and then I will let the a$$ next door make the call, move the light or get a porta pottie. The drains wont cost as much to do as how much they will add to the house so I don't mind the money I'll spend, and I just ordered 60 6' Leeland cypress tree's from my landscaper to put between us they say in about 3 years I wont even know there is a house over there. |
Here is the deal. Approach him a real friendly terms. Suck it up and by overly nice. Tell him that you are spending $800 to help him with his septic problems. Tell him that in return you'd like him to solve your problem with the light. It's a pretty fair deal as you are going to spend alot more than he will. (assuming that your downspouts are actually the root of his septic problems-which I doubt) You hold off putting the drains in until that light is corrected. If nothing happens, write a letter to the city. They proably have a ordinance requiring all electrical work to have a permit. He proably didn't get a permit for the light. The city will right him a letter and he'll have to correct it.

I had a similar problem with a neighbor and his motion sensor light. It was very sensitive and shined into our bedroom at night. I asked him several times to point it elsewhere. Each time he said he would but never did. I started shooting the light out with a pellet gun. He accused me of it and I denied it. No evidence to prove it. After I shot out the light about 4 times with 2 visits from the local police who couldn't do anything unless it was witnessed, he finally moved the light. I didn't think I was being unreasonable at all. He installed it when he moved in 2 months before. I have lived here for 14 years. Needless to say he thinks I am whacked and won't come near me.

The pellet gun is a cure-all for most domestic situations. Just don't get caught. :D
Don't waste your time with the drainage trenching. You have absolutely no responsibility to divert it, if the natural landscape causes the run-off. |

I like what Cord said, then if it doesn't work, try phknlwyr's suggestion. I don't like the pellet gun idea because seeing that he's an unreasonable type of guy, he might start shooting out your windows or even your boat if he gets pissed.
If all else fails, wait until he comes to the house for a weekend, get up early like 5:30am and start your engines with the transom pointed in his direction. Sit on the boat for a while and he'll get the message. I wouldn't perform any trenching work to benefit him until he remedies the light situation. |

1:51pm he just got here I have a boat full of people waiting to go out I'll let yous know how it works out.
I never use my pellet gun it's a Beaman c1 shoots like 1100fps way to noise, I use my 22 with CB loads a bow and arrow makes more noise, well almost. |
I like the exhaust pointed in his direction idea. Take that "late night cruise" to nowhere. Then get back REAL early. :D
If that doesn't work, for a small fee (and an airline ticket :cool: ) I'll come out there and take care of the lighting issue. Gives you complete deniablity. :) |
we had the same problem with a light ,bastard would light up my house like it was 1 in the afternoon. 22 cb load. after they replaced 4 bulbs no more light. have a few other homes around so they didn't know who did it , but me and all my other neighbors did:D :D

The light is off, the drains are in. Spent $400 told him $800 he said he would do something for me. So it's all good for now but it's early yet.
