I am curious. How does your attorney propose to beat that citation? I have been staying clear of Wisconsin these days with my boat. I ran my own test a month ago at idle it was 114db mufflers off and 110 on. Ouch.

Apparently it's a procedural issue. The DNR is not conducting the test correctly. I guess the way the procedure is written, it would be very difficult to conduct the test-especially on the water. The judge from the prior trial alluded that if other citations came before her court that she would be dismissing them for that reason.

Cord, I'm hoping you can be more specific as they are handing out noise tickets over here also. I have heard that the meter has to be calibrated everyday and also adjusted for wind and background noise. But it still makes you take a day off of work and waste time. everbody i've talked to that has actually gone to court has had it tossed.

The dnr guy said that they are not calibrating the meter every day. I don't know how often the procedure requires it to be calibrated. The do adjust for background noise and wind. This is done with a reading taken before testing the boat. The procedure apparently requires them to "lash" the boats together. This is what got the first citation thrown out. I really don't know what the standard calls for, but the attorney is very familiar with it. Apparently the judge is too. From the sounds of things, the test is so hard to conduct, that it will be almost impossible to get a conviction on the water.
