No it's not. Another judge threw it out under freedom of speech (ignoring freedom not to have to listen) as soon as it was passed. They are now saying it could be YEARS until the congress and courts get together on this.
Our personal solution (which has worked great, 3 calls in 5 years) is to have a unlisted,unpublished number. The home number is not given to ANY business for ANY reason, just a work number. Each time we have received a call we (my wife actually) has taken the time to track down the source of the "leak" and beat them mercilessly. Try it, it works!
