Who should pay?
 
I was rafted up on the lake last weekend and someone walking across another boat fell on my boat breaking my windshield. He was a guest and not a boat owner. He admited fault and said he would pay but now I seem to be having trouble getting in touch with him. What should I do? the windshield cost $865 and I'm not going to claim it on my insurance since I have a $500 deductable. I have already paid for the windshield. Should I go after him or should I just absorb it and be done?

Go after the guy. It's an unfortunate accident. That's why I don't tie up with people I don't know.

The guest should get a big scarlet "S" that he/she has to wear when boating so that people will only let them on the swim platform.

I say go after him...................but in todays world, he'll probably develop a back pain and sue you for have improper signage warning that the deck was slippery and some lib judge will award him a million $$. :rolleyes:

I finaly reached him and he said that was an outragous price for a windshield. However he said the check is on the way. It probably has enough bounce in it to make it here from Austin.

Well he should pay....but if he doesn't own a boat the sticker shock doesn't surprise me. I hope it has sufficient funds...good luck (and that went a lot easier than I thought it would).

I'm actually relived I was even able to find a windshield. I few days ago I was in panic mode because anything over 40-MPH the wind would make your eyes water.

He's lucky. Does he know that you could have charged labor? We pay 75 bucks an hour around here for certified marine repair.

Most accidents in life cost more than that.
And sometimes you get your azz kicked, too. (or hurt somebody and feel horrible.)

But I think the "outrageous" comment was inappropriate. Break my stuff and then b*tch about it, too. Uncool.

You can usually ask the bank to verify the funds (they won't give you an exact amount, just tell you whether or not it will clear) And unfortunately if it comes down to it you might be better off putting this on a lesson learned because of the way the courts work these days it might just be cheaper and less headache. I know I know not a popular view (yeah I think he should pay for it) but a bit of harsh reality in the world we live in

Only thing you can do is small claims and that takes awhile, you pay for filing and to have the papers served. And if you are lucky you might get your money, and if you do could be payments. i went thought it once had someone rear end me and had papers served got noughing they never showed up pain in the ass. This is MI though might be different where you are at.

I would send him a copy of the estimate so he knows what it cost. Also if he does write you a bad check you can:

1) place it for collection at his bank if the account is active or

2) turn it over to the county attorney where he lives for prosecution.

I am sure as a non-boater he doesn't understand what things cost but if he checks around some he will be educated...probably won't understand but at least will know.

IF,If ya get the ck and he does not stop payment your good. The DA will collect it if its bad :D . if he stops payment your screwed :(



One thing to think about ,He could of said he got hurt falling on your windshield , law suit :eek: :eek: You never know about these sue happy POS's :hothead:


or just ask him if he has health Insurance and tell him he is going to need it.No witnesses :D broke hand ,fingers ,feet, ankles,Ribs are good too they heal slowly.A small sledge hammer and a phone book spreads out the bruise not to obvious.If ya break something :eek: .Clean up behind your self .It would only be a misdemeanor anyway ,about $500.oo fine.

I see it like this, if your kid broke a cars windshield playing ball, you would pay. Err actually if he is on your property homeowners would pay, but you get my point. You are lucky if he doesn't start acting like he hurt himself, then your umbrella will be paying.

If he pays you happy day... If he doesn't I wouldn't get all sick about it. This is supposed to be fun...If you have to go after him and get your panties wadded over a few bucks it becomes not fun! Pick your poison but I pay for stuff like this just as a part of having fun. Just my two cents :rolleyes:

non-boaters have no idea what our hobby really cost. 2 yrs ago my mom and stepdad where up in mich from florida,he was mixing a drink (bloody mary) on my boat,his glass was too full so he just dumped his extra tomato juice on the floor in my boat!!! We all know how hard it is to keep your cockpit carpet and white interior clean,i asked him how he felt about WALKING back to shore,he couldn't understand what the big deal was!!! Needless to say they DO NOT GET INVITED ON MY BOAT ANYMORE!! Another time i was parked at the dock at a local hooters sitting up on their deck having dinner,some 20 year old punks went walking down the docks near our boat,i saw one of them toss something in boat,by the time i made it thru hooters and down to the dock they were gone,lucikly HIS CIGARETTE he threw in boat was out,some people have no respect for other peoples property. I have two teenage boys,if they ever pulled some bs like this on someone i would kick their a-- right in front of the victim and they know this in advance!!Smitty
