I freakin hate bastards like this...Worst part about it is, I am involved in a claim against an insurance co. so people assume its like that and that everyone gets rich blah blah blah. The truth of the matter, when some ******* does do something stupid (runs a stop sign at 40mph) you get to wait in line after all these other jackasses with no common sense before you get your bills paid. I could have run head on into a brick wall and said I hadn't seen it and it would have been less of a mess, freakin chaps my ass these people get away with such nonsense.

I bet it all would change fast if like in England the defendent can sue for legal fees and damages on frivelous suites.

I think in a case where the plaintiff takes nothing, they and their attorneys should be responsible for the defendant's fees and costs. If the lawyers had financial exposure in some of these cases, it might cut out some of these types of matters. Too many people are using the legal system as a lottery. Hooters was just ordered to pay Wing House's attorney's fees for a case here in Florida.

As I read the story, that was a different issue. Hooter sued Wing House didn't they? They lost the suit and had to pay Wing House's attorney fee's. Not arguing the specifics of that case, only citing the outcome, that example seems fair.

In this case (Sand Hill), this is were TORT reform has a place if the logical "right thing" can't be done in a court. But, we don't know all the details (for what that's worth.)

Buttom line, it sucks!

They keep trying to get legislation like that passed but trial lawyers have a strong lobby.

They should make the BAR exam a lot harder, there's to many lawyers. COME ON BUSCH, lets get this issue rolling!
