Its still yours then go get it. If he signed your name he is in some trouble.
the person that has the boat will have to sue the broker for fraud. I was never legally transfered to him. |

I'd report it to the local pd as being stolen. It's your boat and he stole it. Grand theft is taken very seriously.

Well everyone, I finally talked to Nathen who bought the boat from the broker, he informed me that the DA of Travis County in Texas (Austin) has agreed to prosecute 4-play marine for fraud. Hooray!! See my post , "Helped , robbed by a broker, what should I do?" for other breaking news. Thanks everyone for your support and comments. Tom Richter

Forgive me for chiming in but I have been following this thread for some time with interest. Seems to me that all you will really get is some satisfaction if the DA really goes after this man. In the end, you still don't have your boat!!!!! I agree with many of the other posts with regard to repo'ing the boat and then let Nathan sue you in civil court. While I can't speak for anyone but myself here I have to think that we all feel pretty damn bad for Nathan for the situation he is in. The fact remains that you are still the legal owner of the boat and you shouldn't suffer for it. As a side note, if you stopped making payments on the boat the finance company would be forced to locate and repo the boat for you. By law, you would be given an option of purchasing the boat for the remaining balance owed on the boat to the finance company. Just an interesting thought and my 2-cents....If I were you I would have an attorney get VERY legally aggressive with Nathan and get that boat back. --KevinJ |
