We heard the boat hit boat wakes at 50 mph and driver and passenger were ejected. Driver OK. Passenger broke leg, collapsed lung and broke blood vessels in his eyes. The boat did not roll as in first post. Hope everyone is OK.

Quoted from the article:
“Vessel hit a 5- to 6-foot cruiser wake, causing the vessel to make a hard right turn, ejecting both driver and passenger out the left side of the vessel,” the report said.

Flotation devices were in use and the vessel was equipped with all required safety equipment at the time of the accident.

The cause of the crash was listed as excessive speed."

As I recall from a coast guard certification class years ago, boats are responsible for their own wake. Wouldn't the cause of the crash be negligence on the behalf of the cruiser captain?

Just to clarify a common misnomer: you are responsible for your own wake in certain situations such as causing damage to shoreline property, boats rafted together in a no wake area, ect., however in this situation it would be no different than if I decided to share water space with a cruise ship. Up to me to be aware of the wake the other vessel may make when under way. It's just hard to see exactly how large some wakes are when you pass another boat at even a moderately fast speed. I thought I had broke a boat in half after hitting a cruiser wake before. Hope all are doing well and can get back on the water soon.
