Ok, I was placed in a sticky situation this yr. I took my 2 mercury 700's into a verywell know marina because the salesman at the marina told a potential buyer that if he bought my boat then he would need to have the motors refreshed because it had over 200 hrs. Lost the sale for starters...
So the service rep says this---you have 2 options 1. Use aftermarket parts and get a 6mo warranty or 2. Use new mercury parts and get a 1 yr warranty. I opted for the 1st option because I didnt want to fork over the mercury bill. note-needed machine work..
The service rep agreed to have a very well know mercury mech do the work. He was a current employee. Thats one of the reasons I choose to stay at this service marina rather than go to another place.
I will try to put this easy to understand
----took the boat there in Dec 2011 and then in Apr of 2012 after I was informed the service rep decided to have the work done by some redneck machine shop I started calling complaining and told him I thought his mech was doing the work. I was told he was dressing the motors and the redneck machine shop was doing the machine work only. We went back and fourth for weeks about the machine shop because it has a BAD rep. I was getting calls from friends telling me to get my motors back. I was given 5 numbers to people who all used this machine shop and their motors blew with less than 5 hrs. My rep lied and the machine shop actually did all the work. On their seatrial---.6hrs and BLOWN UP. I told the rep I told you so and the other motor is right behind this one. Please note, I had no issues with the motors prior to taking them in, I was just going off what they told me for a refresh.
I was not going to wait all summer with the service marina and machine shop to point fingers so i requested my motors be pulled and replaced with new mercury long blocks, note: The 2nd motor had a 30% leak down already with .8 hrs,
There is a lot of additional details here but in short--- I had to pay for their mistake after I told the marina I did not want that machine shop THEY took it there-to do any work on my motors. So what I am getting at here is I took 2 fully functional mercury 700's to a marina for a refresh that they said I needed and they sub out to a redneck machine shop with a BAD rep who ends up building my motors and on their sea trail they blew one up and the other was at 30% leak down already. Do you think I should be responsible for the $18,000 additional bill they hit me with after their mistake? Oh, and the service marina settled out of court and got all their money back they paid the machine shop. Whats fair and what would you do? Would you pay the additional $18,000?

Be sure to let others know who it is so they don't make the mistake of using the same shop.
These types of shops eventually get the reputation they deserve. I don't know how these cowards and liars look at themselves in the mirror.

wait for the demand letter with a deadline date to pay. then contact an attorney. keep all you records neatly organized. hear-say is worthless. get facts, witnesses and written docs of others problems as well.
with 3 or more sometimes you can file a "class action". these types of suits typically carry more weight as they involve many that have been wronged and if common issues can be proved, larger settlements are awarded if the courts see a trend.
