Default Registration/Title questions

The boat is from Florida and sold to a buyer in Texas. Now I'm buying it and moving it to NY. The title is from Florida, with the original owners name and signature on it as well the new owners partners signature on it. Shouldn't there be a new title in Texas? Just dont want to run into any problems. Any info would be greatly appreciated. Thamks

The person in Texas is jumping title. They need to get a title in their name and sign it over to you. That title is worthless in NY unless the person from Texas is a dealer and can re-assign it to you.

That is correct.
Sounds like the person he is buying it from never titled it, registered it or paid the sales tax. Only a dealer can do a second reassignment on a title.

You will have nothing but problems trying to register in NY without the correct title.

Ok, so this kinda make sense. The boat was bought by a dealer in Texas and never registered. It is still owned by the dealer and is now being sold by the dealer. Dealers name is on the title still.

If it was a car in Michigan, I would have to take to Sec. of state and prep the paperwork before it left our state. Some states work together and I have to pay the tax here before my customers leave the state.

I had a problem buying a boat from the actual owner. boat the boat off ebay in feb... worked un it until late june, got it running and went to the dmv to register it. Bought it in PA. PA is a notary state, owners sig must be notarized . Never happened, he just signed it and gave it too me. Had to track the guy down which took a few days, fed ex him the title, wait for him to have it notarized and send it back.. I was lucky to find the guy again

As a boat owner, titling a boat in New York State can be a nightmare. I ran into all types of problems when I transferred ownership of my Wellcraft to my daughter. The DMV had given my daughter a real tough time. She is the third generation in the family to own the boat. We spent a week gathering every shred of documentation we had on the boat and went back to the DMV prepared. The person that took care of us (DMV person) could not understand why we were put through all of this. My advice is, have all paperwork in order. Check before doing battle with these retards.

Note: we did get both boat trailer registered.

If he is a registered dealer than he should give you a notorized bill of sale. You will also need the original florida title that should be signed by the original owner over to the dealer. The dealer's business name would then be on the title and signed by him under the purchaser/buyer section.

Somewhere on the title there should be a re-assignment section where it is re-assigned to you (in ny we use form mv-50 to re-assign titles as dealers, i think the florida title should have its own section for re-assignment but you should look into this to be sure) Make sure you get a title for the trailer or a transferable registration and also a notorized bill of sale for that (ny dmv considers it 2 different transactions) filled out the same way as above. The NY dmv is complete torture as I'm sure you know, I have to battle with them on a daily basis, its my least favorite part of the day.
