So they settled for the insurance money. So who wins? What has been proven? So just sue somebody that has insurance and find an ambulance chaser (Mike Alwise) and sue them. Tell me what has come out of this

I haven't followed it all the way, but I believe the allegation was that there was an expectation of the teams that the promoters were providing rescue personnel, and in that representation created a "warranty", if you will, that they would be trained, professional and specifically adept at high speed boat crash rescue. Relying on that representation and understanding, teams agreed to be part of the race, and may even have not used their own rescue boats or choppers.
I don't think the issue was that the promoters guaranteed driver's safety, I think the issue was the promoters failed to provide the type of rescue personnel they said they would, and it appears that the lack of training, knowledge of high speed boat crash rescue, even the knowledge that the canopy cats have a rescue door on the bottom, may have been critical errors that otherwise would have saved his life.
Having said all that, I don't know that there wouldn't still be a lawsuit even if all went correctly and he passed anyway, but nine+ minutes to get to someone out, even to the untrained observer, seems like a problem. I hope the outcome is not to kill the sport, but to make it safer for all who participate. Only time will tell on that I'm afraid.

In the McDonalds spill a cup of coffee on your lap law suit, the result was a disclaimer on the cup to the reference that that contents are hot and can burn.... I guess we have to make a decal and post it on our dashes that says "You can die doing this"

Maybe we should put decals on the side of rock cliffs to warn the climbers just in case they didn't realize.

I would never expect it would take over 9 minutes to get me out of a crashed race boat and I bet the racers did not expect that either.
Its so easy to say its silly but when someone dies because someone else did not do what they said they would do then there is a problem. If you can't hold anyone accountable what kind of world would that be?
Looking at the photos that Doc posted blew me away. I had no idea thats what happened. Hard to argue with the facts.
I hope we learn from this and not let it happen again.
