Not necesarily. Ive been involved in my fair share of collections lawsuits. This may vary state to state, and even court to court but if the name of the business you are filing against is not registered with the secretary of state then the court may toss your case and make you re file or amend your case to the owners name vs. the business name. I had a case that was tossed becase of this, I went on to find out that most of the companies assets were in fact in the owners wife's name, or split between the owner and his wife. I amended the filing to the owner and his wife and ended up with a judgement granted in my favor......YAY!!!! Still dont have that 50 Cary in my barn tho.

Just becase you "win" (judgement granted) doesnt mean that your going to get **** out of it. You cant get blood out of a turnip, same holds true with the mob mentality. If they dont have it, your not going to get it PERIOD! Blood doesnt pay my suppliers and put that Cary in my barn MONEY DOES so why open yourself up to criminal charges just to get nothing??

If you want to go lynch the guy at least have enough fuking brains not to talk and or brag about it on the world wide web.

I was the one that posted his first Powerboat ad on OSO and congratulated him on it. Personally he was a gentleman and I never had issue with him, but business was a totally different story. You've read the issues, seen the pictures of the office and you still feel for him??? How about feeling for all the guys here out thousands dollars and the suppliers that are out hundreds of thousands of dollars?

I would wager that Fred would wish his only problems as of late were financial ones. While I have no dog in this hunt, and am in no way condoning or excusing Tricks business practices, I still have compassion for the loss of his Son. I think this is what Mitch was trying to convey also.

BTW, this is not intended as a bash, just an observation.

I'm with ya , ditto on all of the above. I think after his son got killed it went down hill. Business is business but a death of a son had to be devastating.

You know, one guy I feel really bad for in this entire situation is James.
He's a young man that just lost his girlfriend in a terrible accident, and now he's gonna lose his job. Talk about throwing a monkey wrench in your entire life.
It's a shame he if he feels he can't show his face around here anymore because of affiliation. I know if I were him I'd be afraid to say anything here, to only be grilled for an explanation as to what happened - which should have been explained a long time ago by his boss.
I liked his "guess the musician" threads.
This has caused damage on many levels.

Back to the pictures of his shop. I assume there was a warehouse behind the walls? Those pics looked more like the scam workings from Nigeria.

All the Fred lovers and supporters should start a tread to help save him and donate to pay those who are owed then you will truly see how many people support him. I bet not that many.

I am Not involved with Trick Marine at all (meaning that I have never done buisness with them) but have been Reading the posts that have been Put up. I am not here to bash anyone and am sorry to all that are having troubled times with Trick. I am however in buisness and can give a little insight into credit card company's. YOU DO NOT HAVE TO PAY FOR WHAT GOODS OR SERVICES YOU NEVER RECIEVED!
A short story of an incident that happened to me as a dealer..... I am in the furniture buisness, at 15 min to closing we recieved a phone call from a customer saying they would like to purchase a dining room set and matching bedroom set they saw, however, they would not be able to make it back to the store by closing and asked if we would take the order over the phone. They described to the tee the location of the merchandise and even gave us our coded numbers from the price tag, so someone was defidently in the store. We took the order and set up a delivery date with them. MANUALLY entered the full amount, and delivered to them thier merchandise. When we got to the apartment, there was no-one home but a neighbor came out and let us in the apartment, he said the tenant had to run out to get supplies cause they were moving in. We delivered all the furniture and left the location. A month goes by and we recieved a call from the credit card company asking to see the credit card slip that we ran for the customer. When we asked why they said it was a stolen card and they wanted to see the signiture. When we told them it was a phone order, they said, "NO SIGNITURE = NO SALE!!!!!!!!!!!!!!! We were beat out of $10,000.00 We naturally went back to the apartment and lets say let ourselves in, Place was empty, and so was the Neighbors. We later found out it was a scam coming from inside the jail, where they had people going around from the outside describing furniture, and taking numbers and the person in the jail would call and order it with stolen credit card numbers. We were not the only ones it happened to, they hit about 8 furniture stores in the area.
Bottom line, according to the credit card company's and lawyers, NO SIGNITURE = NO SALE!!!! So Everyone that orders "on-line" can ask thier credit card Company if that person has a signiture to the slip and they are not held responsible for paying the bill. This also goes for catalouge and phone orders. Hope this info helps and good luck!
