So I sold a 400 dollar power tool to a guy "Hilti hammer" in a woodworking web site. I included drill bits and all kinds of stuff and packed it with shrink wrap as dam near new. He paid me through pay pal and now says I shipped him a broken tool and wants a price reduction. I say no way and pay pal said to me on the phone to upgrade matter to a claim. So I do. I send pics of the ad to paypal I send all the pics e-mail between us etc that I have on file on my pc and pay pal rules in his favor. Just like a rubber stamp they take his side. The tool I shipped him was mint clean etc. He says that he got tool with cut cord, dirty cracked housing, no drill bits, ****ty packaging etc. My wife says he is probably shipping back a drill he already had and will get mine for free. I am so mad I could spit nails. I phoned pay pal and they said that if he returns it and it is worse than what he has stated the item is I can file a claim and the can try to do something. Well how worse shape can his drill be that he is returning. They went on to say that he has 10 days to return it to me ( march 1st) and if he doesnt it gets closed. The prick never e-mailed me or anything. No contact at all, just to pay pal. I just dont get it how can he me over like this. Can any of you think of anything i can do. The guy is 500 miles away from me so I cant drive over a lay a lickin on him as much as I would like to. What did I do wrong here. How could I have protected myself from this. I have a perfect record with e-bay. Pay pal took 24 hours to decide the case. i am so pissed off I am going to have to go out for a while and shovel snow or something. Any heads up I would so greatly appreciate. have any of you ran into this? I will check back later after I get rid of the foot of snow that fell.

Use the box on paypal mark as "Gift" then I don't think they can claim against you

I can't tell you what to do with this claim, but for futire, the SECOND that you get the money from him in your Paypal acct, transfer it out and into your bank acct. Then if there is a claim, at least YOU have the money and it goes from there. Paypal makes things "easier" to buy/sell, but they could care less about the buyer. Don't EVER let them pull money from your bank. Always use a credit card, and AmEX would be the perferred choice, as they will back you a lot better than MC/Visa will.

Does the drill have a serial number?If so and you recorded it and he sends you a different one it is now fraud.I used to do a lot of stuff on E-bay but its just not worth dealing with the idiots.

Thanks for the replies. I bought that drill hammer because at a habitat build the inspector would not let the pile of volinteers continue because the water line had to be re-swedged in the basement floor so instead of everyone going home I ran to the store and bought the tool and fixed it so we could continue. We could not cover anything up until the water lines were all under pressure. I used the dam thing one time.
Well all the snow has been shoveled and I have cooled off a bit. As far as paypal goes I have both a checking account and a Mastercard listed with them. I did remove the funds shortly after getting the transfer from the buyer because I wanted to pay down my credet card which I put the original purchase on. I had a few hundred bucks in pay pal account left and the other day I bought a an ignition box from a member here so now my pay pal account is negitive 300 bucks and change. I have the serial number of the unit that I sold the prick. I guess I will see if it matches what he sends me. The fuscker wont accept e-mails from me the just bounce back. Pay pal told me on the phone that he has 10 days to send it to me and on their e-mail to me they say March 1st. Is that his time limit to get a tracking number listed with them, or the time limit he has to get it to my address? The pay pal guy on the phone said they often root out guys that are scamming by the fact that the buyer has to pay for shipping back to me. I am still royaly pissed off. If I had a lot of money I would get on a plane and kick the out of him. |

Ya no this is about the money but I think the reason i am so pissed off is pay pal is fasilitating his scam. I only gave a pracy of what happened in this deal here. If we were in a court of law and I laid out all the details as I did to pay pal he would be laughed out of court and wouldnt get to first base with this bullstit crap. I just dont get it. Why do they just rubber stamp this grrrrrrrrrrrrrr. I am sure I am not asking for an answer but just venting.

I was a ebay and paypal user for 8 years, 100% ebay rating with over 400 tranactions, ( most with paypal) paypal forked me over 3 times 2 time when buying and the last when selling, I have been done with the bastards for 2 years now, I do miss buying and selling on ebay but refuse to deal with paypal

Paypal did the same to me tool. It was on a prop. And get this, The guy kept the prop and money!!!!. It was about 4 months later with b!tching back and fourth i brought up getting the courts involved. I layed it out plain and simple. You bought a prop, then you recieved the money back for the prop. Now you have the money and the prop, thats stealing donw care what you want to call it pretty blunt here. So sent the money or prop. If not Police and courts will be involved. I recicved my money But paypal said nope your wrong he is right. I said where is my prop then. They said not out issue just the money aspect it. I was like WTF thats idiotic!

I have 100 FB on ebay with over 1200 transactions. I still hate Paypal. They jacked me a couple times and are very high on fees (as is ebay). Does not help they are owned by ebay. I feel your pain they are a royal pain in the ass to deal with when there's a problem of any kind.

The guy probably had a job to do, used the tool and ruined it and is now going to send it back to you. Some people do not know how to take care of tools!

I dont use paypal anymore. Earlier this winter I bought a motor off of ebay and was sure to switch the Paypal primary funding source to my CC instead of the stand alone bank account that I set up years ago for Pay Pal that now has practically a zero balance. A week goes by and I get an email from my bank stating an NSF along with a $30 fee.
I call paypal spend 10 min on hold, then finally explain to the person my problem she says OK hold please, then I talk to the next person whom I have to explain the whole thing to again and she says no problem well fix it. Another week or so go by and guess what, another email from my bank stating another NSF and $30 fee where the Paypal tried to run the charge to my bank account instead of my credit card. I call again having to explain everything TWICE in 20 minutes. This time they tell me that their software is setup to automatically charge the primary funding source (that I had already changed to my CC) two times in a set amount of days before they try and charge the secondary funding source. And that there is nothing they can do to overide the system. I'll never use them again. |

The drag is that if you use ebay to buy or sell, paypal has you by the balls because they basically control ebay, in that it seems like that is the only way to pay, or accept money.
I did once try to pay a guy outside of paypal for an item with a money order, and I got the... "Uhhh... I never received the money order yet...." That went on for 3 weeks until I called Western Union to confirm that he cashed it! Is there any other SAFE way to pay for stuff online without using paypal? |

what you need to do is use a credit card when you pay for anything on paypal that way if there is a problem you can do a charge back thru your credit card company and ebay owns paypal not the other way around that is why you are forced to use paypal with ebay transactions i use both everyday and i have only had a problem once and it was the guy scammed me on some stuff and i got screwed but not by paypal they did give me some money back but not all of it since i did not follow their rules on shipping

I had to file a claim because the seller would not take the item back, which was garbage (I bought off "stock" photos) I returned the item, but the buyer did not have the $500 in his account, pay pal told me they can not "charge" his bank account or cards without permission and they could not refund my money until he has the money in his actual paypal account. He closed his ebay account and I am sure he cut the ties with the paypal account, all over $500. Looking back I should have used a CC instead of cash out of my bank account. |
I bought a video card once and paid via PP. I sent $400 and the seller sent me a small box of garbage elecronic parts. Long story short, PP sided with him. I was out the $400 because he sent something and it's not their resposibily for the condition of the item! PP Fing sucks!!!! :mad:

well the guy returned a hammer to me, no serial number, and trashed Not even the same vintage as far as I can tell. I called the cops and they didn't want to do anything said I should take them to small claims court. I re-explained to him what happened and he told me to call the cops where the guy lives,. So I called them and they told be to call the cops where I live. I called the cop back and re-explained what happened and he said that they would take a report but wouldn't investagate. I then called paypal and gave them all the details and they said don't go to the cops until they send me an e-mail. I said I was going to the cops anyway. I went to my paypal account and found it frozen. I guess they are not liking me causing all this fuss. Could be that I left a negitive balance. Went to pay with credit card and it says I need to register it? Not sure why I need to register it when I have made purchases on paypal with it. Anyway good thing Home depot listed the serial number on my bill. The saga continues. I will be at the boys house in the morning making report.

I feel your pain.....I have sold on Ebay for years and was very upset when they bought Paypal and basically MADE everybody buying and selling have to use it.....
Recently I sold an item and the buyer lives in Hungary, they decided to pay for SURFACE shipping, it actually cost me more then I quoted to ship but I sent it anyhow. TEN days after the auction he contacts Ebay and files a complaint that he hasn't received the item...WTF? He then emails me and I explain that it will take some time because of the distance and the fact it went "surface"...........a few days later Ebay emails me and TELLS me they are refunding him out of my Paypal account for the full amount he paid!!! I know I am flogging a dead horse trying to reason with Ebay or Paypal and I can kiss my money and the item goodbye...........one thing I did ask them was, "What happens when he receives the item...???" When I heard paypal was having people monitor multiple gun site classifieds and trying to match up sales on them with transactions thru paypal to lock accounts, I closed my paypal and ebay accounts. Ebay was getting to be such a pita anyway, it's not that big of a loss. |
Paypal tried to screw me out of 2700.00. I transported a boat from Boston to Flordia and accepted his credit card through paypal. His enclosure got torn up because the zippers were frozen and I couldn't take it down. I called the owner and told him I had to cut the zippers to remove all of the canvas. He told me not to cut them that the enclosure was very old and he was going to replace it after the season anyway. I went about 10 miles and it was all blowing apart so I stopped and called him back telling again him I had to cut the zippers to salvage what was left of the canvas. He said ok and paid on delivery by credit card. Then he filed a claim, and paypal sided with him. My insurance co refused to pay him saying it was his fault and too old anyhow. Paypal tried to take the money from my account but I beat them to it. Now my account is suspended but screw them.

The next instalment:
Went to cop shop and showed them everything and explained everything and they would not take a statement. Said they would only do so if they intended to persue the matter! Said it is a small claims issue. I went home and called Pay pal. I started to explain what had happened at the cop shop and the agent interupted me and said " no problem, I will send you an e-mail with links to organizations that will take an online report, and you fax us that report and we will get back to you and have a nice day". I got the e-mail and there were two links for Canadian's to use. One of them is Phone Busters, that the R.C.M.P refered to, in an off handed manner, when I called them. At the time I never thought much of it. Welll I made the report with C.A.F.C ( Canadian Anti Fraud Corp. formorly known as Phonebusters). and copied it and set the papers in the fax and it spent the whole day trying to send it. The machine on the other end wasnt picking up! I called them again and they gave me another number where it went through right away. I guess I wait and see now. |
Someone is gonna have rubbers hanging out of their azz and it's not gonna be paypal. They suck. They change their policies to suit the situation and don't back the ones they have in writing. they make it such a runaround and time waster that they hope you'll give up and write off the couple hundred bucks. I ditched them a while back. As others here , ebay seller w/ 100 pos fb and a couple hundred sales. F ebay and paypal.

Heres a great paypal story, I purchased a durmax pickup in texas drove 1000 miles to pick it up, naturaly the dealership missrepresented it , but they had over 100 trucks on the lot so I found a different truck, left my trade with a title and paid the difference in cash, to make a long story short it took me over a year to get a title the dealership filled for bankruptcy the following monday and the title for the truck was held by different dealer, paypal wouldnt even give me the 500.00 deposit I paid at auction end, they said because I have the merchandise, I told them with out a title it is worthless, they said too bad, they are theives and someday i will get even.

Ok this whole thing came to an end today and this is what happened.
Turned on computer this morning and got e-mail from pay pal saying that they denied my appeal. I said Wot? I was so mad my wife said my face went through several metamorphoses ! There reason they gave was that I did not add any further evidence from the initial clame so they regretted to tell me that to bad so sad. Good thing nobody cut me off on the way to work. when I got in I hung my coat up and got on the phone strait away. I got the same guy that helped with the credit card registration and he kind of remembered me. After he read through the file for a bit he said "what can I do for you?" I asked him if they even read the documents I sent via fax? he said he was reading them as we spoke and they are reviewed by a claim evaluation team or something. Well at this point I let into this guy like he was on my wife in my house! He then asked me " well what are you out ? I said wot? Didnt you read the dam thing? He said how much money? I pulled the bill out of my wallet and read him the total. I asked him if he had internet and he replied yes where I directed him to the home depot web site so he could see the tool there. Well he said fine and would credit the whole amount to my account. I said wot? And after a short pause I thanked him. I then asked about the guy who ripped me off? He said he would put his account on review. I said thats it? he gets to do this and thats all you do? He said if he has a pattern he will be banned. I then asked him what I could have done to avoid what happened? he said not too much and there are people out there that do that kind of thing and if they continue they will get banned. I asked what I should do with the hammer drill that he sent me and his response was to keep it! and have a nice day! On my way home I took a major de-tour and met with the executive director of habitat ( I needed to talk with her on another matter anyway so it worked out good) and donated it to them for future builds and not for them to sell it. She was grateful and promised it would go in the "keeper" inventory. I have explained all this in this thread in hopes it will inform people. I had no idea what all the rules and BS went along with pay pal and how a crook gets delt with. I hope it is of some help. All I can say in closing is Wot and episode !! |
Do you have a phone number for this guy. I've been trying to straighten out my problem for 2 years buy everyone I talk to is in Indochina or something.

This is the one I have used and I was talking to people in nebraska I think.
1-888-204-4481 After a few promps like " can we use the number you are calling from to get your account number" then they ack for the last 4 numbers of the bank account associated with your account" then you wait for an operater. Then You need to ask for a "level 2 claim expert" They have the most power and are the most informed. |
