They call it accidental insurance. In some cases maybe it should be called carelessness insurance. Doesn't matter, you could argue in a court of law that you hooked your lanyard and it inadvertantly came off - probably has happened to some of us one time or another, it has to me. I've also just plain forgotten to hook mine at times - get to where I am going, reach down to remove it and find I forgot to hook up in the first place. I did not intend to forget, I just plain forgot.

The laws are written around intent - and we can all be assured that these guys never intended anything like this to happen - that is why they call it an accident.

But on the other hand, for the folks that consistenly drink and run their boats, consistently refuse to wear lanyards and take other safety precautions, I have a hard time feeling real sorry for them when something happens. I feel sorry for the others that are victims.

best of luck with everything you guys are going through. the only guys that havent made a mistake are the ones watching from the dock......

In Illinois it is illegal to operate your boat, if equipped with a lanyard ,without it on. Last year at a poker run, we were wearing our life vests and lanyard. A guy came by me and asked , "What are you going skiing" We were the only one wearing vests at the event? 40 boats. I don't get it? If you come out at high speed its going to hurt and Knock the sh*t out of you. You won't be able to catch your breath, might have broken bones, and you will drown unless you have a vest on. Please wear your vests and lanyards.....it will save lives.

I only asked the question, because the policy I got on my new to me Daytona through Allstate didn't make it through underwriting, and I will be getting a new policy through Markel. To get the policy through Markel I had to take the Tres Martin Performance Course. We were told during the instruction that they will not cover this type of accident because it is Negligence. Since I don't have the new policy yet to read, I was wondering if this is accurate. Maybe this is true just for fast cats?

We all do hope you guys are recovering quickly, and are glad to hear there were no serious injuries. I dont believe anyone meant to call all you guys idiots... JUST THE DRIVER. Seriously most dont mean to make fun of, or bash, insult, etc.. the driver, but the point needs to be made that only luck made it that there were not people aboard the other boat. And for alot of us to do take safety seriuosly, it pisses us off knowing there are drivers like him out there operating boats.
Accidents do happen and mistakes do happen, but stupidity and arrogance of not operating a boat safely is neither an accident or mistake.

That would not surprise me because Markel specializes in go fast boats. Car insurance companies generall will not touch high power or cats.

Geez I must have been at the same poker run - only this year. Out of all the boats. (probably 40-50) we were the only crew wearing saftey vests and I'd bet laynard as well..

For all you people taht are ****ing talking **** about the people in teh accident it needs to stop were all lucky taht their alive and no one else got hurt during this.I bet 90% of u *******s dont even wear ur lanyards.and for you people talking crap its over the computer and thats it lets see u talk it to their face.
