Logos for SeaDek - Approval from Cigarette Question
I have sent my templates off to SeaDek for one of my winter upgrades. I have requested to have a logo/Cigarette lettering in it, and SeaDek says I need written "permission" from Cigarette for them to proceed. Does anyone on here know who at Cigarette can give me this letter? If you have someone's extension or number I can call, please PM me. I have made my initial call to their published phone number and spoken with the first line of defense, who then said the second line of defense was currently on the phone and would call me back (not to be pessimistic, but I have been down this road before, with no calls back). Thanks in advance.

I would guess that permission would have to come from Skip or Bud. Bud is easier to reach if you don't have their cell phone numbers.
Manufacturers are usually fine with using a logo for your personal boat and not trying to sell them or profit from it. Like selling clothes or engine hatch patches. |
Jeez, aren't there already enough Cigarette logos on it? :)

I spoke to someone at Cig about this today. You're gonna be hard pressed to get a letter. They are SUPER sensitive about their trade mark and it's a lot more complicated than just issuing out an authorization letter to a company. The only option is maybe have the portion of Seadek sent to the factory to have it etched by them. Like Bubba said, I'd call and talk to Bud but don't get your hopes up too high that you'll get the OK from Cig to have it done else ware and it will probably cost a pretty penny to have Cig do it.

Has it been that long since you were in school, well ditched school and somehow obtained a signed letter from "mom" stating you were sick yesterday......

I have spoken to Chris at Cigarette, and he is supposedly contacting my person as SeaDek to see what/how to proceed. Hopefully they can work this out.... Once he speaks with the rep at SeaDek, and they come to some sort of understanding, he will present it to Bud. This is what I gathered on the phone with him after a couple of conversations. Seemed helpful up front... Time will tell!

the legality of it isn't a question, but the old adage of asking permission or forgiveness. one of the things to look at is if you have a boat any brand and it has a logo painted on it, you actually own that boat and the right to change the paint and add logos where you want. if you own a chevy truck, and want to add something on it with a logo as long as you aren't trying to sell said log for a profit and manufacture it using the trademark you would be 100% ok. I think even as a business if you make a product for someone for their boat and include the brand name i would find it near impossible for the manufacturer to sue and win... if that were the case, every boat that from every manufacturer is in violation of every person that painted them.

I think it's ironic that a guy who owns a Cigarette needs permission to put another logo on his boat but boat manufacturers have been copying and splashing other manufacturers hulls as long as fibreglass molded boats have been built. (Not referring to Cigarette, just a general comment)

I have been involved with this type of situation with motorcycles. I have received the bible thick paperwork from lawyers a couple of times from the likes of Dodge and Shelby America. Here is the way it has worked out from my experience. If you own the property that the said logo is going on and you are not profiting from the sale of the property, you are not in violation as long as you own the property and do not go into manufacturing or representing this as a manufactured available product. Reference building a tribute car i.e. a HEMI that is really not a HEMI or your bicycle and you put HEMI stickers on it. Here is the catch, the person or company painting, manufacturing a part, etc. is liable to the logo owner IF they use said logo in a build, paintwork what have you and sell or give this work to you. It does not matter if a profit is made or not, permission and access from the logo owner must be obtained. I get the argument of hey I just want a logo on this part and install it, but the nuts and bolts of it are pretty cut and dry. Restoration of a logo has been ok from what I understand.
Officially licensed products from sports teams are the first example that comes to mind. |
I bought new carpet for old boat from Corinthian. The cost for carpet with the logo increased by about $450 (if my memory is correct). I said, uh - no logo. $325 ish shipped (vs $775).

Well, I am trying to play by the rules, and get the required permission needed. I have since located alternative methods of getting this done, but my calls are in and have been returned from Cigarette. I just hope this gets done before the Tickfaw, preferably well before that point. We will see.....

After going back and forth via email and phone calls between SeaDek and Cigarette, they finally worked out the details to get this deal done, playing by the rules. Total Marine Performance did the measurements and install, and it turned out great!! This definitely took some patience, but seems to be worth it!!

The way it works, is you can send your order to SeaDek, via your local vendor or directly, and SeaDek will work up a quote. From here, you pay Cigarette, and Cigarette pays SeaDek (Not sure if you have to get the written permission or not, since I have gone through it already??). Not sure why it goes through this process, but I figure Cigarette wants to keep control of who gets it.... |
