$250 Ticket for loud exhaust
This afternoon I was headed down the intrecoastal to put the boat on the trailer. I was only going about 35 MPH. I was pulled over by the marine patrol for the 2nd time since I got the boat. Last time he gave me a warning on my exhaust. This time he wrote me a $250 ticket. It says over 120 DB. He said next time he's impounding the boat.
This is very frustrating! Are they cracking down on loud exhaust everywhere?? |

even in mich they are starting to be jerks about this.....there is only one guy that is a pain in the ase......my boat is far from the power of your guys but he still likes to mess with ya ................MOST OF THE TIME I JUST KEEP GOING AND ACT LIKE I DIDNT SEE HIM, AFTER ALL IT IS NOT LIKE I CAN HEAR HIM.........

here at loto- they escort you back to your dock or to the boat ramp, I and alot of others got tired of it and went with the custom turndowns, I know a good friend who ultimately ended up blowing a motor after putting several mufflers on at the same time, heard Florida is now starting to crack down, all of the MTI's here have the turndowns. thought you were selling your boat?

120db??? Measured from what distance?? Something you might want to find out: Did he have the SPL meter set on 'C' weighting or 'A' weighting? It should be on 'A'. A weighting is a setting that follows how a human ear hears and C weighting is just "flat" across the board. If he had the machine on 'C', then it would read a lot higher than 'A'. If you were moving, then from what angle did he take this measurement??? If he registered 120 from the side or something, then you should have no ear drums left. Rule of thumb: Sound loses 6db everytime you double your distance from a source. This does not take into account atmospheric effects (that can increase the lost) and the fact that your pipes are like waveguides focusing the sound.(which can decrease the loss over distance) Either way, there is probably something here to go on to challenge this. Sounds like they just have a vendetta against offshores. They must protect the yacht owners at all cost!
Personally, I think the cop caught his wife with a Nortech owner or something :eek: |

MUFFLING DEVICES
All vessels must be equipped with an effective muffling device. The use of cutouts is prohibited, except for vessels competing in a regatta or official boat race and such vessels while on trial runs. This is the "law" I pulled off of myfwc.com Real specific isn't it??? :rolleyes: I so far can't find a spefic county law for Broward, but I'll keep looking. I think the ticket is full of Donkey Ca-Ca myself! |

Personally, I think the cop caught his wife with a Nortech owner or something :eek: I would check like UNSANE said......I also think that readings are taken at idle(in neutral)l from 3 meters behind the boat. I would challenge the format this guy used to get a 120DB reading and the claibration test of the unit used. Also I would check to see if the noise law in FL allows them to take your boat for noise levels. :mad: :mad: |

Well one community up by the Ringling mansion on the water complained so badly that as a wake up call the City Commission actually came out and stated they were considering a speed limit on Sarasota Bay. There was a meeting held and lo and behold the real issue was noise. They bluehairs didn't like the noise of the PRA spring poker run although they went out New Pass. A lot of false info came to light in that meeting that the there was a lot of "error" in the complaints. Anyway to try to make everybody happy the three individuals representing the offshore boaters (Mike Erturk-Prez of OPBA, Joe Spina who owns Loose Cannon, and I'm sorry I can't remember the third individual) they suggested not running close to shore in that particular area (Indian Shores) and so far it appears to be working. The compaints as far as I know have ceased....:drink: |

I would fight it. I know of no addittional noise law in Broward County. Besides I am sure you were conducting a sea trail following some engine work....hence going to the trailer.
327.65 Muffling devices.-- (1) The exhaust of every internal combustion engine used on any vessel operated on the waters of this state shall be effectively muffled by equipment so constructed and used as to muffle the noise of the exhaust in a reasonable manner. The use of cutouts is prohibited, except for vessels competing in a regatta or official boat race, and for such vessels while on trial runs. (2)(a) Any county wishing to impose additional noise pollution and exhaust regulations on vessels may, pursuant to s. 327.60(1), adopt by county ordinance the following regulations: 1. No person shall operate or give permission for the operation of any vessel on the waters of any county or on a specified portion of the waters of any county, including the Florida Intracoastal Waterway, which has adopted the provisions of this section in such a manner as to exceed the following sound levels at a distance of 50 feet from the vessel: for all vessels, a maximum sound level of 90 dB A. |

A new Suzuki GSXR 1000 with a full Yosh. sys. on a Dyno at about 5 feet away during an all gear run 2-6 gears at red line only gets to 112db. with the meter set on A level. There is now way he had the meter set on A.
My boat is loud, loud enough that people clap and cheer when I am done docking and turn it off, and I have never got a reading higher than 105db in the cockpit. 120 db is like standing in front of the big speakers at a CREW concert, ( it's are's go to 11) loud. no way it's 120 db. |

So bad here in my area that I haven't been on the local lake in 3 years :mad: . Trailering a couple of hours every weekend takes alot of the fun out of owning a performance boat. This fall I'm sending mine back to Nor-Tech for the underwater exhaust conversion. Whats next????? Paint not appealing to the blue hairs!!!!

I've been boating in Florida for 35 years, just this spring I saw the only sign I've ever seen concerning noise levels.

I'd want to know how he got the reading of 120 db. "IF" thats correct, thats eardrum breaking noise. The 90db standard is usually at rest, 1 meter off the transom, and 1 meter off the water. and they need to do all sorts of background readings first. Without some serious mufflers, its unlikely you could come anywhere near to passing that test. most stock twin engine boats without mufflers can't pass it. My single engine boat with mufflers is at 89 db.

now they will be doing the running tests, even on the underwater muffler systems running they will not pass and they will cite you for that, ask 3600cat and white lightning at loto, once they get a hard on for you your going to have to constanyly deal with it, I used my boat twice this year until I finally got the turndowns, now I'm nervous to get on plane, I'm always watching out for them, stay in the middle of the channel for sure and just get out of it if you see a water patrol, pull a kill switch lanyard and say you have a motor down,

120 DB?? OK, I'm what, 150/200 yards from Goldmans, and I have NEVER heard anything that freakin loud running over there... Anyone pull a drug test on the LEO??

I ordered mufflers from CMI, they were supposed to be done 2 weeks ago and I still don't have them. I should send the ticket to them! :mad:

Gino, If you were in the Bahamas you wouldn't have gotten a ticket! You were on the list for the Poker Run, what happened? 2 MTI's made it over and one broke a belt at Bahia Mar so he went but his boat didn't. Water was rough, rain sucked but we had a nice ride back this morning on flat water 20 miles outside of West End all the way back to the inlet. |

I agree, fight it. If you are running straight, dry exhaust you may actually hit 120DB but no way at 35mph at 50 feet.
SAE J34 is actually 25 meters not 50 feet. Somewhere they must reference the measuring standard criteria? I'll start looking also. Michigan is cracking down also (and proposing new criteria). I always try to watch this. I did not know "Captains Call" or "Cutouts" were illegal in Florida. I am VERY GLAD to see you are using the boat. Stay healthy!! |

120db at 50ft (16m) would translate to 144 at 1 meter in a perfect world.
If that was taken at 25 meters, then that should translate to 148db at 1 meter. Now that IS loud!!!! 120 at the front row of a Crew concert???? Try tacking an additional 10 or 15 on top of that!!! My personal best was an average of 125db around 80 ft away. Thankfully those levels were for 60hz and below so I wasn't splitting ear drums.........I was splitting colons and merging organs!!! For example, I was merging peoples' livers and spleens and creating Splivers in the process!!!! :evilb: :evilb: :evilb: This sheriff guy's name might be Musthafaroduphispoopr :eek: |

man, i don't understand how captain's call or cutouts could be illegal, quiet when needed and full out loud in open water. hell, my denali hits 155db on the dash and i've never recieved a ticket for "loud system" or "noise pollution"
