Now you made 100 K and still have the boat.

Good idea though. LOL

NO not a scam......I will post all the required info. Waiting for NYS to send me criteria. A legit third party will draw the winning ticket. Drawing to held in the showroom the day after Thanksgiving 2008 or before if we get the desired 400 tickets sold. Everyone can come down when the ticket is pulled BTW. No clsed door BS.

That's cool that you can do that in NYS.

Up here, we have to do the drawing on the date and time approved by the state, and we can't sell tickets until the license is issued. Tickets must carry the license number and drawing date.
I had to submit the the dates of drawings over a year in advance. The license is only valid during the one hour approved drawing time. And the license cost $450.00.
And that's for a non-profit.

Sounds like New York is much more lenient than MI. If I had advertised my raffle prior to receiving the license the fines would have been steep. NYS rocks.
:drink:

TSPM 09-14-2008 02:39 PM

BTW...as far as moneys go....we are not cashing anything in advance. We might do one of two things. Wait till we get close and clear the checks based on the amount sold. OR Cash just the winners check....if it bounces the runner up gets the boat. We do not want to hold peoples moneys up and if we do not reach our goal we dont want to spend countless hours writting refund checks. We can just mail the un cashed check back to each buyer.

Good luck.

03darkshadow 09-14-2008 03:40 PM

I'm so tempted to buy a ticket but i have no idea what i'd do with a 37ft AT. but i have no luck and couldnt win a raffle if i bought 99 tickets.

I'll be sending a check in once that happens. I wouldn't have considered it at $1K, but if all the info is put out there, I'll take a chance at $250.

I started the $ 250.00 ticket request. Post the rules and I'm in. You should post all names that buys a ticket daily for every one to see. That way every one can see there ticket number posted.

Sunshadow 09-15-2008 03:13 PM

I assume all the I have no luck, I wouldn't know what to do with this boat, you would have to pay taxes, aren't raffles illegal posters cant afford $250 for a chance at a pretty cool boat. Stop wasting time posting and get back to work. I talked to Paul at TSPM this morning and dropped a check for 4 tix in the mail this morning. I've never won anything before either but I'd be happy to start here. P.S. I worked my ass off for that $1000.00. :ernaehrung004: (o)V(o)

With all these "i have no luck" people, it should be raising the odds for all others! Is there a website we can read about the rules and stuff? Is there a cash option? Good job keeping us informed! And Daredevil, why not delete you old post now that you feel better!

Here is a website with rules regarding raffles in NYS.
http://www.racing.state.ny.us/charit...aqs_raffle.htm

Couldn't find anything on non-charitable.

Depending on the response (which looks good so far) we might extend the time frame to 30 days....lets see what happens.

I don't think Jupiter's tax question has anything to do with state sales tax, it has to do with federal income tax. I don't know for sure, but my guess is the feds will consider the difference between the payment and the value taxable. But other tax gurus can probably clear that up.

Certainly an org accepting checks has "official docs" by now.

Please post a .pdf of your license.
And also... please identify the non-profit, they deserve some PR from being involved in this. I want to visit their website. I want to learn more about any non-profit that partners with offshore boat sellers. Way cool. Love them.

Oh... and have you identified the impartial third party making the draw yet? That would be comforting to know.

I want to buy a ticket.

Just need to look into that non-profit and verify the state docs.
Need to see the language.
Thanks!

I'll second that. Would like to buy some tickets but it still appears that you started this without any of the correct paperwork and approvals in place (just how this thread reads) and the devil is certainly in the details in a transaction like this.

Is there a CLEAR title for this boat???

I would hope with the 100k collected, it would be clear by the time the winner went to pick it up.

Anybody know what kind of tax liability there is if you win?????? How does that work???????? Sorry, but I don't have 30k laying around to pay taxes.

If it is like anything else you win in this kind of situation, you will owe Fed taxes on the difference between the value of what you win, and the cost of the ticket(s) you buy.

They raffle off a 250K house in our community every year. Win it, and you owe your tax bracket on what your gain is.

So if the IRS values this boat at 200K+, you are going to pay more than 30K in taxes.

But look at the bright side - you can sell your current AT to pay Uncle Sam.

Griff 10-17-2008 01:46 AM

Problem is when/if I sell mine, in todays market, I can pay off the loan on it and maybe have enough $$$ left to fill the tanks in the new one a couple times.

I would argue that the boat is worth 100k. It was posted that it could be bought for that much.

Craney 10-17-2008 03:11 AM

What % is your state sales tax?

JoeD 10-17-2008 06:15 AM

Half way thru the game you change the rules? I believe thats fraud.
You cannot change the odds of a game once it has started.

I Lean more towards keeping your 32 & selling the 37.:evilb: You could get alot more gas:rolleyes:

Questions:

How many tickets have been sold to date?
Where on LI is the pick up spot?
Don't need an exact address - just wanted a town - I live in Westchester and wanted to think about the logistics of hauling it up here when I win :drink:

CanDo 10-17-2008 08:51 AM

Active Thunder Auction?

I think I'll sit out on this one. Theres other boats out there anyways. the markets flooded with better boats than the AT anyways. Take your pick.

TSPM 10-17-2008 11:22 AM

OK here are answers

The boat and traileris free and clear titles.

The LDA of New York State
Learning Disabilities Association .... it will be on their website in a few days.

LDA of New York

The boat is located and be picked up in St. James New York

We changed the odds before any tickets weere sold and updated with the state as 1 in 400.

The amount paid for the ticket is not deductible as a charitable contribution. They are deductible to the extent of gambling winnings (i.e. its treated as a gambling activity).

The winnings being taxable is a grey area. If properly set up it could be considered a gift (i.e. not taxable), but the general rule would be to treat it as gambling winnings.

The actual odds really didn't change anyway. If you spend the original $1000 and buy 4 tickets your odds of winning are still 1 in a 100.

There's a lot of possibilities. Maybe sell the less 37 less power & drives( & put them in the 32)or put um both up for sale and see which goes. The problem is I need another 6 feet of garage for the 37.
