Law suits

Does any know how many law suits have been filed against Cig.,OL,or anyother boat co. where their boats have hooked and barrel rolled. Just a point of interest. People sue for everything now.

two-air 12-15-2008 11:10 AM

I don't think Cigs. roll....:D

BAJA WILL 12-15-2008 11:19 AM

HUMMM very odd subject to bring up, from someone with very few posts.

Kind of like suing a motorcycle company for falling over, I think in most cases, the conditions that would be necessary for a large water craft to roll/spin, would also be ruled "the operator was operating speed in excess of safe operation"

One would argue it was driver error and not the watercraft.

Got to be honest with you, I have spun a 32 non-stepped boat and it was hard a chit to do so,and not something I wish to repeat. And yes I had to push the boat to very unsafe operation to do so.

Wrongful death attorneys frequently sue everyone possible in a case, it isn't uncommon for them to also sue a manufacturer, same with cars, airplanes, trucks, mopeds , etc........ they cast a net and see what comes back in.

Bored, just something to throw against the wall. Should have said spun out.

Knot 4 Me 12-15-2008 12:05 PM

Why would you want specific numbers by manufacture? The public is not going to have this information and the companies aren't going to disclose it.

cigracing1 12-15-2008 12:22 PM

Word on the street is that Derryberry Performance is in a lawsuite over the old Sunsation Dragon boat that rolled or hooked. Can't remember the whole story. But its been going on for awhile now.

TexomaPowerboater 12-15-2008 12:40 PM

I would find the home state and county and search their court records. Lots of good information there. If you are considering doing a new custom build I would also look for this information. Some of it is hard to access via public info, but an attorney should be able to get those court records for minimal cost.

LostinBoston 12-15-2008 12:40 PM

every state or country will have a court records search available. Check the country that the incident happened in as well as the county the company is located in.
For Miami the website is
http://www.miami-dadeclerk.com/civil/pubsearch.asp

type in the name or some local boat builders and you can find some very interesting things.

wildhorses 12-15-2008 03:19 PM

You guys are getting way to techinal,is just something that came to mind.I have a 2000 35 top gun that you couldn't turn over or spin out if you wanted to. Every time I read about the new fast TS Cig's they always wind up talking how they are easy to spin out or roll. If this happened lots of times, then there could be a problem.

smiklos@sunprint 12-15-2008 03:36 PM

Mike Allweiss usually has a full case load for similar boating accidents.

Yes, the problem is almost always, ignorance !! Ignorance on the lack of knowledge of how to operatethe boat, or too busy to go to school and learn. There are some that are just plain mistakes and accidents though...

OHH trust me 6-8' waves crank the wheel in full, at 70mph you can spin it, again nearly any boat can be spun or rolled if you push the wrong conditions at completre unsafe speed. Kind of like rolling a car, if you try hard enough you can.

You hit the nail in the head right there. I just sat in on a cival deposition where a guy got confused, stopped on the train tracks and got hit (killed) by an Amtrak train. Lawyers for Amtrak and GM (he was driving a GM) were there because the family was suing both.

Dipsh!t, screws up and gets taken out and somehow it's amtrak and Gm's fault!? I'm sure the family just wants to settle out of court.

Is it just me, or does anyone else have a tough time following Airtimes' stories??

Sorry dude, maybe it's the pain pills....I would know cause I've have a few surgeries lately and the pain meds make me ramble on.......

Cost of goods, Insurance, Health care, cars, boats, medicine all would go down if we had Legal reform

Why don’t we get good Legal reform? Because over half of the politicians out there are lawyers

I have a simple rule I do not vote for any one in office that is a Lawyer

Look what we just put in the White House Three Lawyers
Obama, his wife, and Biden all lawyers

Single reason we have so little morals in this country is the legal system

The odds of winning a lawsuit are something like 1 in 10
Versus the odds of winning say the US Power Ball Lottery are 1 in 80,089,128

No one should ever be able to sue for pain and suffering!!!! Life is pain and suffering!!! I have been married 4 times I need to sue someone for the pain and suffering

I got hit by a car in 99 while at work I was halfway out of my truck, I thought I was all right and never got the drivers info, well I needed surgery and since I didn't get the info ,I TOLD MY sister and FATHER DON'T WORRY I WON'T GO OUT ON COMP, I put it on my auto insurance they said fine but no weekly checks for 7 mons just medical payments, so when I got hurt both knees in 04 at work , my workers comp has dragged out my knee replacement for 4 years with other cheaper surgeries every year. 5 to date three they paid for two I paid for while waiting to take them to court in 04 for 8 mons. If I sued people that hit my vehicles over the years I would be a millionaire:p. so yah I agree theres to many sue happy people out there.

phragle 12-18-2008 01:47 AM

well, I suppose you will have to determine your overall financial status to determine viabilty, and you will have to hire 2 lawyers, one to sue yourself and one to defend, or else you will have a conflict of interest, which could tie the verdict up in appeals for the next 20 years.

vette131 12-18-2008 06:36 AM

deputy sheriff comes up on a horrible wreck scene. A bus full of
lawyers had turned over in a road construction zone, so he calls his captain. when the captain shows up he sees the deputy driving a bulldozer . the captain asks what are you doing? I was burying everybody. the captain asks, they all died? some of them said they weren't dead but you know how lawyers lie!!!!!!

How true this is. Most taxpaying Americans don't realize how much money is really built-in to MANY if not ALL goods and services you all purchase on a daily basis. I call it "Insurance Burden".
