There seem to be no question who is at fault.
It seemed to happen in a special zone where other boats should stay clear. The prohibited Zone is 1000m ahead, and 100m either side of any vessel over 150m in length. The tanker in question is 265m long.

This incident was in Cowes Bay New Zeland but the international rules still apply.

Sailboats do NOT always have the "right of way". BTW, it is now described as a "stand on" and "give way" vessels. Stand on vessels shall maintain course & speed, give way vessels shall avoid stand on vessels. Here's the "Pecking Order":
1) Any vessel being overtaken
2) Vessels not under command (typically a mech. problem, steering etc)
3) Restricted in their ability to manouver (conducting underwater ops, etc)
4) Constrained by their draft (likely the tanker in this situation, must remain within the depths limits of a shipping channel)
5) Fishing vessels (engaged in fishing by towing nets - trawling, NOT trolling hook and lines)

And finally (6) Sailing vessels (under sail only, NOT sail and power). So ALL sailboats must "give way" to vessels 1-5 above. That sailboat hauling ass and overtaking your power boat in San Diego Bay does NOT have the "right of way".

The law further states that when the action of the give way vessel alone is deemed not sufficient to avoid a collision, the stand on vessel shall do whatever needed to avoid a collision. Otherwise the stand on vessel shall maintain course & speed.

7) Power driven vessels
8) Seaplanes on the water
9) Any vessel overtaking another vessel, must stay out of the way of the vessel they are overtaking.



Bottom line:

Sail boat Capt. was at fault.

It looked to me as a crewmember of the sailboat fell overboard as the tanker approached and they were attempting to haul that person back into the boat as it was hit.

i give the capt. credit he is in a race, he knew that if he waited for the tanker to pass he's done. So he went all in. he might not of judged the tanker properly or thought it would slow down, but you really have to admire the size of his balls for a blowboater...

Our local blow boat organization took $43,500.00 of your fuel tax money from the Clean Vessel Grant to build a marina facility on a public lake. They then have denied all access to Fishing and power boats, Against the terms of the grant that state it must be open to all boats.....

Still waiting for the calls to ban sailboating races.........chirp, chirp.

These sailboat races are more dangerous than the poker runs. On Texoma they have one that runs all day and thru the night on a HOLIDAY! Sailboats racing.............at night............on a holiday. Couple years ago one ran straight into a cruiser at night.

In some, if not all, parts of the world the ship that is working has right of way. Working boats (especially giant ones like tankers) usually follow are fairly consistant path. It's the legal obligation of the recreational boater to get out of their way and keep the shipping channels clear.
