We're in CA and pay sales tax on a purchase, and property tax every year to the county where the the boat resides on Jan 1 each year.

This is only correct if the boat is purchased from a dealer. If it's purchased from a private party, use tax is due within 30 days of purchase. Do a google earch for IL RUT-75.

My buddy finally got some info on why he was audited. The state is saying that what they have determined to be the fair market value of the 3 boats he has bought since 2006 to be greater than the purchase price of the boats and they want to collect 6.25% tax on that difference. Not sure how the state is determining what the boat's fair market value was at the time of purchase. Obviously it was not reflective of the soft market over the last few years.

You arent going to beat the state. Government has hired more bean counters than ever. The days of scamming the system are over. Although I do think that its BS to have to keep paying salest tax on an item that is used 2-3-4 times overs. Somebody brilliant like earlier will say just most, well thats economical. And you can fight it, but it will cost more to fight it than to just pay it. And whoever said 90k people left because of this, come on now you serious. |

If the figure is below what they think is the value at time of purchase they audit and want documents showing real value. They have gotten a lot more aggressive chasing tax dollars. If they think you didn't pay enough for the boat and taxes the ball is in you court to prove them wrong. You can take a hard nose approach like someone mentioned but I know they will not go away.
If you think you can stall them the surprise will be on you, if the decision is determined you didn't pay enough tax you pay interest from date of purchase. Stalling only benefits them - more tax/interest. Rick

Sent them a copy of the CASHED CHECK that I provided to the state for my sales tax. Got another letter about 2 weeks later saying thanks, but that wasn't good enough...they wanted a bill of sale from the private seller, along with something showing how I paid for the boat...savings withdrawl, cancelled check to the sellers, loan documents, money order receipt, etc. I guess they didn't believe that I bought my boat for the deal I got it for.

My transaction was 100% legit, and I was still audited. I got a steal on my boat, and they apparently didn't believe me until I furnished them the proof they wanted. They've since sent me a letter saying that my audit file has been closed since I provided them with the proof they needed. |
