38 hrs later, I would say you are responsible for getting it fixed. IMO internal engine rebuilding mistakes usually show their ugly face within the first 5 hrs, maybe 10. I guess there is a chance he missed a crack a small crack in the rod.....how are you going to prove that after 38 hrs?

Other things may play a factor, was the engine low on oil?

A crazy as it sounds, we are also responsible for protecting any warranty. The guy that changed your sea pump, you need to be the one after the fact making sure the engine is not runing hot. The guy that rebuilt your engine, you are the test bed. If you have low oil, oil pressure, hot oil or hot water you need to be watching that stuff and shutting it down to protect your warranty. Our engines are under constant load, running hig RPMS unlike a car, if a problem shows they must be shut down ASAP.

Have you asked the builder or repair company about coverage?

Was this the same block that had # 6 rod come apart once before? The previously broken rod could have cracked the block & Cyl wall, then small amounts of water from the water Jacket leak into that cyl while running & more so while sitting still. (did the oil ever have water in it after the rebuild?) after enough heat cycles the crack could have let in enough water to hydro snap a rod, even a very small amount of water can do it. when the crank (Rod Journal) is almost at the top it has such a mechanical advantage nothing can stop it, so it snaps the rod very easily...

Agreed. It sounds like cracked water passage or leaking head gasket. Since this engine overheated before, did the builder deck the block, and shave the heads so they are true? Was there a crack that was not found in the heads or block? Do you have an overtemp alarm?
