I wonder if liability to perform changes with a "pro" vs. Just a standard schmuck renting a lobster boat......
There are laws (especially here in fl) against non fl licensed contractors performing repairs on homes..... I am a licensed captain with a towing endorsement....but I do not work in a tow for revenue capacity. I got the endorsement only to be a better captain. However, the local sea tow office called me when the horizon caught fire and subsequently leaked oil into the gulf because all of their captains jumped on the bp cleanup gravy train and left them without qualified trained and experienced tow captains. The first thing they asked me was if I had my endorsement. So....if the pros have minimum guidelines, why wouldn't "joes"? I own a flatbed rollback international tow truck.....but dot would hang me out to dry if I didn't have a license to tow with adequate on hook liability insurance....even with " not for hire" on the side. It is seeming more and more like Admirality laws dispute every other right that guaranteed to us by the constitution and all subsequent amendments. To me, it seems like it is there specifically to ALLOW piracy. Pros and joes get to operate under the protection that these phucked up and outdated laws provide.....and the pros are quick to point this out. I don't think they are retiring today on selling (stealing boats). I know there are police all around down by the coast to stop looting, I'm sure someone either sh*t their pants or was given a "Is that your boat, if not leave it!" talking to. Anyway, now I'm thinking: maybe it means they're the evil boat stealing men. And I'm the righteous man. And Mr. 9mm here... he's the shepherd protecting my boat in the valley of salvage. Or it could mean you're the righteous man and I'm the shepherd and it's Sandy that's evil and selfish. And I'd like that. But that sh*t ain't the truth. The truth is you're the weak. This is an interesting thread, and being a lawyer I really don't know sh*t about Maritime Law, I handle criminal and traffic offences (DUI) mainly, but I will look into what the law is in regards to boats set adrift in the hurricane situation we experienced here in New Jersey, and what , duties, and limitations are afforded to the owners and the salvagers. Looks like it is time to expand my breadth of legal expertise, I will do some legal research on Westlaw or Lexis, and what the rules actually are regarding this topic for New Jersey citizens and boats located in New Jersey this week and get back at you when I have a general answer that will be a good starting point. I actually found an ad in South Jersey Craigslist yesterday advertising this $hit!!!! Boats for sale, said " they washed up or were left floating, bring a trailer or crane if you want something big!!!"
The ad even stated this "maritime salvage law" BS, I am one to try and make a buck when an opportunity presents itself, but this is just out of line! |
