I cant' figure out how OCM thinks the remaining $175K is all theirs ($280K - $105K). Calling it working capital sounds like a prelude to "we spent our capital and will not be paying for the rest of your boat".

Hey OCM - where's the remaining $175K? What's your reason for holding on to these funds?

Chuck, you traded a 2008 Nor-Tech for a new custom boat... I'm guessing you are a very intelligent/successful person. What do you hope to achieve with a forum post? From your past post 'hope the new boat owner gets wind of this' is to drag another boater into your delima.

GET A ATTORNEY! If this is a 'easy case' as your attorney has suggested - it should not cost 50K.

My sorry, this forum is great for fixing some problems - this pedicular case is not one of them.

Well I hope your wrong and I have seen a great deal of bad deals get resolved over the years once they have been brought to light on OSO. As I have stated in a cpl different posts , winning a case doesn't mean you get paid. I'm not interested in wasting 50k or even 1k if I don't need too. As far as the other customer is concerned I think he should know that me and my bank have a prior financial interest in the property. Thanks for your reply though!!

Why would somebody that lives in NY, 'sell'/trade a boat to a dealer that is in Oregon who is then 'brokering' a new build from manufacturer in Florida? The logistics seem pretty far out.

I am no attorney but based on the values and the events this would be considered "theft by conversion" and at this value would be considered a felony in most if not all states. if you are tired of dealing with it just contact the states attorney and the police and let them do their thing. yes he can close down and change company names but it is hard to do business from a jail cell.
