Spectre is fully aware of the situation and has repeatedly asked for the funds to complete the boat. I even asked that the funds be put in an escrow account to assure everyone good faith. I was told " why would I put my working capital in escrow". My reply was that it isn't your working capital it is the funds from the sale of MY BOAT!!!!! I am hoping that the new owner will see this thread and also push Oregon Custom Marine to fund the new boat so that I can release the lien on his boat.

As said by ski doc, i would contact the new owner of your old boat. Legally he does not own it and has a right to know that, being as you have kept up on the payments you could walk right up to it and take it legally and resell it. it may also force OCM to do the right thing. Whether or not they realize it they are already breaking the law..

I wish it were that easy Rob. When I previously told OCM that I was going to reach out to the new owner via OSO he begged me not to and later claimed that I told him I owned the boat free and clear. That claim is obviously to defend himself of any legal action. Regardless once he knew of a lien on a sold boat it should have been addressed. I can have the lien release as soon as the new boat is completed.

I've looked into that and legally it isn't stolen. Unfortunately it is a civil matter.

Try to find the guy that bought your Nortech, I am sure he would be pleased that the Oregon dealer sold him a boat with a lean on it and has not paid it.
Also I am no expert but the dealer representing your Nortech as free and clear and selling it to the buyer as such would be a criminal act.

Who is holding the title for the boat and I presume the trailer, I have never seen a bank loan money on something and not put their name on the title, that secures their interest in the matter, I feel for ya, in the end the guy who bought your old boat might be holding the short straw.

I'd also contact all the manufacturers they supposedly represent and let them know what kind of "dealer" they have. They list some that don't want negative pr associated with dealers who are less than standup. On the OCM website they list Nordic in addition to Spectre. I'd also post your message/story on all the performance boats forums, especially the ones that have a large local presence for them. Performance boats forum, River Dave's Place, etc. Stop playing nice guy and contact the new owner and mention your lien and that your going to pursue because of OCM.
