Yes, you are guilty. The roadside breathalyzer is used as a field sobriety test to determine if you should be arrested for DUI/DWI. Once arrested, you then must take(or face penalties as BBCLiberator said) a breath test or blood test. Those results are what are used as evidence.

Just hold up your piece and show them the "safety". Then holler over "Yep! I just checked the safety", and there's the safety check

Been boating for over 30 years ( 22 on St. Clair/Huron ) and know that having had a couple safety checks although they were always a follow-on to another reason for being approached. Thought maybe some would chime in with their experience.

I got stopped for a routine safety inspection last year; as they were alongside the officer started to hand my papers back but made it so I had to lean well over to get them, at that point he leaned close to try and check my breath, he was so damn close I was afraid he was going to stick his tongue in my ear. I had not been drinking and had water in my cup holder, however 3 of my passengers had beers in theirs. It did not go any further than that.

I have been told that the presence of alcohol in view is enough to start the process.

BELCHERTOWN, Mass. (AP) — A western Massachusetts police chief is facing scrutiny after it was disclosed that he appeared to be drunk when he was pulled over for driving erratically in February, but was not cited or arrested.
Granby police on Wednesday released a report that indicated Belchertown Chief Francis Fox was pulled over in Granby on Feb. 1. According to the report, the officer who pulled over Fox felt he was put in a difficult situation and Fox asked him ‘‘if he knew who I was.’’ The report says Fox was unsteady on his feet and almost fell over when he got out of his vehicle. His breath smelled of alcohol and his eyes were bloodshot.

Fox was driven home by the Granby officer.




We had another case locally, cop was drinking at a sandbar all day. She ended up crashing her boat into a dock. The boat on the lift landed on her, she lost an arm at the shoulder. She was rescued, had the best medical care. The arriving officers wanted to prosecute, the state attorney declined.

For the most part my boating experiences have been great. However, there have been 3 or 4 instances where I was harassed without cause. Once for going "too fast close to shore". I was doing 60 mph about 500 feet from shore. Ironically, the cop's first words were "If you want to drive like that go back to Lake St Clair".
