Here in Richmond...White VAN at gas station on Broad. **** load of police puled up, dragged man out and arrested him.

All hell is breaking loose..check out the news...developing...

If the news reporter said arrested its probably because they dont know the difference. We all know you need probable cause to arrest someone, a suspicious person isn't enough probable cause .

Just some FYI so people arnt running around saying that officers are arresting everyone with a white van, ya know how some people love to start stuff.

There is a BIG difference between being detained with the use of handcuffs for *officer safety* and being "under arrest".

It is no different. The moment of arrest occurs when when a person is no longer free to leave. You do not need to be handcuffed to placed under arrest. Also, just because you get arrested does not mean that you have to be charged with a crime. Being handcuffed for officer safety is still technically an arrest.

That's really splitting some fine hairs Griff. You can dispute that all day in court if admissible evidence was at stake. For all intense purpose, in N.Y., you are not under arrest until the officer udders the words "you are under arrest".

This stuff is getting too close for comfort. That gas station is only a couple miles from my house and Ashland is not too far either.
I've seen people running serpentine paths to their cars.

Last labor day I spent 20 hours in a jail cell, 6x8 with 2 other smelly adults, 1 named Bubba (wondering where my boat was)was cuffed, finger printed, mug shots taken, went to court 4 times, hired a lawyer, spent $1,200 bucks missed 5 days of work. For a boating DUI that I gave blood and the results were 0.03 (0.10) is legaly drunk and all charges were pressed by state fish and game commision officers here in Phila.pa. The charges were Finaly dropped by a judge. NOT, The cops who arrested me. THey refused to drop the charges> BUT I was never arrested, I was told this when I tried to sue for harrassment. :D

I stand corrected on my previously quoted statement and agree with you completely. Investigatory stops, Terry stops and Traffic stops do not apply and are not arrests, even though the person is not free to leave. They are "stops" or as you said "seizures" of an investigatory nature for a reasonable amount of time.

The only thing that bothers me about Troutly's post is it's dependence on the definition of "reasonable". Given the recent post "Death of Common Sense", it's probably only a matter of time before someone drives a bus through that potential loophole. Anyone see the latest? They've "detained" two "persons of interest" who were sleeping in their car in a Maryland rest stop. They may not be the guys, but it looks like it might be real progress. Once they find the right people, they should tie them to a stake and let the victim's families blast away...

Just heard on the radio that they're sure the two guys arrested this morning are the shooters. They're waiting for a search warrent to open the cars trunk and seach for weapons. Cops won't make final announcement till they're positive it's them.

Use a bb gun, everyone gets one shot, rounds continue until it's over...It might take days. Proceeds go to benefit a worthy charity or dispursed to the victims' family members!

This/these guy/guys is/are not a "Islamic Extremeist(s)"... the only thing this guy was trying to do was line his pockets. Doing things for a cause that you believe in, well that's one thing... doing things because you're whacked out of your skull, well that's another thing, too. But killing innocent people for the sole purpose of greed (and making it look like some serial killer on top of it) is waaaayyyy beyond low.

Being stuck in the middle of all this (it felt soooo good to be able to walk out of the house this morning and not be worried about being shot) it's hard to even come up with a way to feel about it all.

Let's just hope that this is the end of it.
