Patience Running Thin
Back in february my boat was stolen out of winter storage. We made police reports insurance interviews and so on. About 7 weeks after we had made the final recorded statement they released the repair shop. They had to send it in for some glass repair b/c the jacka$$es that stole the motor droped it and cracked the fiberglass. Approx 3 1/2 weeks into the repairs my ins. company stoped repairs and told me they needed to do more investigating because they felt they were being overcharged. 2 weeks after i was told this i found out the adjuster didnt consider depriciation and agreed to the entire repair bill. I was also told that my checks were being overnighted and repair were to continue as planned. Then my adjuster went on vacation for 2 weeks and nothing hapened on the claim. Now they want credit card recipts for all items i added before theft occured, and they are passing the claim to some special claims dept. in ohio. I feel like they are trying to find a reason to cut the cost now that they are liable for the full amount.
I dont know what to do at this point, I have an atourney on retainer for my business but dont want that headache yet. Any suggestions would be greeeeaaaatly appreciated. |
Just stay on them and keep insisting on them fixing right. Make sure you call them at least a couple times a week and let them know that you paid you insurance and you want your damn boat fixed. If you let them investigate,and then investigate again and again they will find some stupid jacka$$ reason to not pony up and pay for it. Let them know you mean business but be cordial about it, yelling and threating with attorneys will get you no where.

I have not mention anything to them about an attourney. I have however, been sending all information to my attourney on a weekly basis or as it happens for review. I call my adjuster every other day to be sure my file stays as close to the top as possible.:mad: :D :mad:

File a report with your states Insurance commission office.
It works when you got to trial .They perk up if they think they will loose there license for that state. It worked for me . but took 6 months . I will not play around waiting and them putting me off anymore . It doesn't pay to be nice to them they will walk allover ya . A adjuster's job it to save the insurance co money by denning claims and cutting them back . They even get bonuses for it. |
State farm got suied a few year back . It was called bad faith suit . It was millions

what ever you do be sure to read the back of any check you sign to deposite from the ins. company . they will screw you by putting that if you sign the check it is full payment and then when you try to get the rest of your money they will say you signed off on full payment.
they did this to me on a car, and my lawyer got them to still have to pay because I did not sign it with my legal name, I signed it with the name i go by. |
use the word lawyer and lawsuit a lot, they seem to pay attetion to those along with the F bomb when i yell at them

Get in touch with your State Insurance Commisioner. I have done so in the past with great results.

what insurance company is dicking you around so we can all avoid using them :mad:
a friend of mine used to be an adjuster. he told me insurance companys will jump thru hoops once the State Insurance Commisioner gets involved. in missouri , once you contact the State Insurance Commisioner a timeline starts and the insurance company has x number of days to settle the claim. We have reported this to Texas Dept. Of Ins.. They say we need to have more estimates on the repairs before they can be much help, BS. The only problem with that is that the shop has allready started repairs ( per Ins. Co.) and i cant take it to another shop for price comparison. The prices are not out of reason. I did my homework on prices and quality before i chose the repair facility.

i think by non current he means this is an old design. Atleast I would hope thats what he means.

The parts are new and still in box. They are just not 03 04 models they are 99 00 01 models. At least that is what the company is claiming them to be. I have seen the motor before they busted it out of the crate. I will definately check this all out before i get the boat back, if i ever do.

I can tell you from personal experience insurance people are the biggest *******s in the world. Some moron ran a stop sign the first week i had my new truck and t-boned me.
I have had to fight and yell and cuss for every single penny from day 1, the people had the nerve to tell me they didn't "owe" me a comperable vehicle to the new truck i just bought, even knowing I have tens of thousands in medical bills piling up. They picked a fight over $600 on claims that will probably end up into 6 figures. They want to nickel and dime you to death, now after weeks my own insurance co. refused to total the truck and kept telling me how they would make it perfect. $14,000 worth of work and $3,000 of rentals and now I have all the problems I told them I would have with it. Now they want to act like they don't need to deal with me until its time to collect premiums. Then my agent gets upset with me when my bill went up $30 this month and I dropped the F-bomb on the phone with her. These people pull your pants down tell you to grab your ankles and expect you to smile and be happy about the huge peice they broke off in you. I'm 20 years old and my 98 year old great grand father moves better than I do, no more riding motorcycles, jetskis etc... and these people still don't freakin get it. I take $10+ in pills a day just to get around and be able to sleep. Plus I got a new truck thats all screwed up and aint worth ****. All I can tell you get a good Lawyer and stick it to them. It always seems greedy to hear about lawsuits and all that BS until you are the one getting raped. BTW, my ins. co: State Farm other ins. co: Geico I would say state farm is better than a lot of others, but thats not saying much. Sorry for the novel, its a touchy subject with me. |
I'm missing a link here. Did your insurance company approve the people working on the boat or did they simply approve you getting your boat fixed? Here anyway, if you have a claim you have to price it out, get a quote and they review it. If it's approved, wouldn't it be binding?? It seems to me if they approved the people and the work, they don't have much room to complain.
As for State Farm....they will try to stall you forever til they give you a check. Years ago, my ex hubby got rear ended while sitting at a red light. Open and shut if you ask me. The driver that hit him was covered by State Farm. We jumped through all the hoops to get the claim approved and they began stalling. I am a woman of little patience. On the third day I called and asked for the check. More stalling. Finally I said "Ya know, my husband has a bad back and I haven't even brought that into the equation. You don't want me to go there. Maybe I should be calling my attorney?" I had the check an hour later. Much like (some) people, insurance companies will deal you as much sh!t as you're willing to hang on to. If you don't stand up for yourself, nobody will. I'm not implying you should drop F bombs all over the place, but you need to put your foot down. |

Insurance companies are the worst. They lose billions in the stock market, and somehow they get permission to raise rates to cover their losses. Still can't figure that one out. Does that mean if we lose money in the stock market, we can bill the insurance companies for OUR losses?:rolleyes: I've had a couple of go rounds with insurance companies. The one thing I've learned is that you have to really stay on top of them. I call every single day, sometimes twice a day. I go to my local agent's office. Basically I become a horrendous pain in the ass and finally they got the message that I was not going to go away. I got the state insurance commissioners office involved as soon as things started stalling. I never swore at them but I let them know I was angry and not going to quit. Finally got the money but it was a fight. What others have said, be careful of everything, particularly the check that you endore and be sure it does not read "endorsement constitutes claim paid in full" or anything to that effect. Texas is the most insurance company friendly state. Run from any insurance company that has their home office in Texas. Especially health insurance companies.
