Default Canada Muffler Law

Anyone here fight and win ? I've got my hearing scheduled for June and looking for any winning arguments. Was idling out of the marina with my silent choice engaged and the fockers pulled me over anyways. Said they couldnt hear me talking and that constituted proof that silent choice was off. Even after I threw the switch a few times to show them they wrote up the ticket and drove a way with big ass f-cking idiot grins.

Interesting...

Anyone in Kelowna have experience?

I haven't heard the latest but thought there was a fight there for noise laws on the Okanaghan. I'm on the Shuswap...hope nothing comes there.

Not sure if this will help, my experience is in US waters (Lake Erie, Niagara River). As I understand the law in order to have this hold up in court an actual decibel reading needs to take place. The reading must be taken so many feet away from the transom. The argument I have heard is that an accurate reading is almost impossible to take due to background noise (other boats, ect.)that influences the test. Not sure if a law enforcement officers keen sense of hearing is admissible as evidence.
Not sure if this 100% accurate, but might help

Default Beware - run silents don't count.

As best I can tell, switchable systems don't replace mufflers. Must have mufflers full time. In fact, use of a muffler by-pass system "silent choice" is illegal. See attached.

You can only run silent choice IF the system switches between thru prop and thru MUFFLERS.

My suggestion would be to get some clamp on mufflers, slap them on and take some pics for proof that your silent choice system is LEGAL according to the law.

Otherwise, the system must be made inoperable and locked in the thru prop position.

The law is really straight forward. No noise limits, just the demand of full time mufflers.

Thanks for the replies. I think I'm pretty much screwed but I will try to twist some technical mistakes to my advantage, cross my fingers, and hope for the best. My ticket was from 2009 so I'm not even sure if the law was the same back then. As for clamping on muffler tips, that'll be good for future but cops took pics of my transom and headers so cant go that route this time.
