Charges Filed In Grand Lake Boating Accident

TULSA, Okla. (AP) -- Misdemeanor charges are filed against two men Tuesday after a boat accident on Grand Lake in northeastern Oklahoma that killed a Georgia man in July.
Delaware County prosecutors charged the drivers of the two boats involved in the accident. John Special of Stillwater is charged with negligent homicide and leaving the scene of an accident or collision. Jason Bandy of Tulsa is charged with negligent homicide.
Investigators say it appears both men had been drinking before the accident. Neither one has been arrested.
35-year old Murray McGarver died in the accident after being thrown from the boat in which he was riding

one boat gets ran over and because they have been drinking and the passenger was sitting on engine cover, he is charged also?

As the captian of your boat, you are responsible for the persons in the boat. I dont know the whole story but if the captian put them in a dangerous situation he will be charged. Negligent homicide may be a bit extreme on Mr Bandy so there must be more to the story.

you get hit in a car and you been drinking you are getting a DUI too, even if the accident wasn't your fault....
