Charges Filed In Grand Lake Boating Accident

AP - 10/17/2006 12:19 PM - Updated 10/17/2006 4:08 PM

TULSA, Okla. (AP) -- Misdemeanor charges are filed against two men Tuesday after a boat accident on Grand Lake in northeastern Oklahoma that killed a Georgia man in July.

Delaware County prosecutors charged the drivers of the two boats involved in the accident. John Special of Stillwater is charged with negligent homicide and leaving the scene of an accident or collision. Jason Bandy of Tulsa is charged with negligent homicide.

Investigators say it appears both men had been drinking before the accident. Neither one has been arrested.

35-year old Murray McGarver died in the accident after being thrown from the boat in which he was riding

As the captian of your boat, you are responsible for the persons in the boat. I dont know the whole story but if the captian put them in a dangerous situation he will be charged. Negligent homicide may be a bit extreme on Mr Bandy so there must be more to the story.

Were both boats underway? Is it illegal to be drunk in a car that is not running?

the gentle man that was ran over and killed was sitting on the engine hatch talking as they were idling. Jason Bandy was driving the boat and talking with his friend when they were ran over by mr. special. He should not have been sitting on the hatch, but charging jason bandy with manslauter seems a little extreme compared with being drunk ,running over a boat and going on home.

absolutely! called APC... Actual Physical control. If you are drunk, sitting in a car, TOSS THE KEYS! It rates just like a DUI. Jail time, fines, ocurt the whole shebang.
