A prosecutor with the Montgomery County District Attorney’s Office who was arrested on suspicion of driving while intoxicated has been suspended with pay, an official with the DA’s Office said Friday.

Morgan Anthony Bourque, 30, a misdemeanor court chief, was arrested early Friday morning in Houston.

“We obviously treat these type of cases very seriously,” said Chief Assistant District Attorney Phil Grant, who heads the office’s Public Integrity Unit. “We have not yet determined the appropriate disciplinary action, but will evaluate it.”

Bourque, who has been with the DA’s Office since June 2008, was arrested by the Houston Police Department around 1:15 a.m. in the 2500 block of Ralph Street, located in the central Houston area, HPD spokesman John Cannon said.

Officers saw Bourque’s vehicle driving about 50 mph in an area with a posted speed zone of about 30 mph, Cannon said.

“They used their lights to pull him over,” he said. “Officers detected slurred speech and signs of intoxication. They performed (field sobriety) tests and obtained a breath sample.”

No probable cause hearing had been set as of Friday afternoon, a Harris County District Attorney’s Office spokesman said, and the case had not yet been assigned to a court. The spokesman did confirm the DWI charge.

Bourque had not yet been booked into the Harris County Jail as of mid-Friday afternoon, according to an e-mail from a Harris County Sheriff’s Office spokeswoman.

The Montgomery County District Attorney’s Office has cracked down on DWI and boating while intoxicated cases since District Attorney Brett Ligon was sworn into office just over a year ago.

Ligon brought in Warren Diepraam, formerly with the Harris County DA’s Office, to create a DWI program. Diepraam, nationally recognized as the top vehicular crime prosecutor by both Mothers Against Drunk Driving and the National Association of Prosecutor Coordinators, has stepped up the county’s joint agency initiatives against drunk drivers during holidays and the summer.

Bourque has been an “excellent prosecutor and a hard worker,” Grant said.

“Obviously, he’s innocent until proven guilty,” he said. “If the allegations are true, we’ll have to take appropriate disciplinary action.”
