per the courts records Berk got a $127,000 judgement against Pantera. Obviously he may have difficulty getting his money. Meanwhile in another record it appears father Pantera bought all of Pantera's assets possibly prior to the Berk judgement.

All I saw was 5 pages of judgements against them up to 2009 couldn't see anything to do with the Berk case or what am I doing wrong?

query "pantera" there are 400 plus records against a variety of pantera names. go the the very end and you'll find the judgement.

Click on the icon under the IMG column when you get to list of judgements and it will display the court document.

Who will be 1st to pay, Pantera or Chapparrel guy?

If they moved / dispersed/ redistributed assets during the period of time following the INITIAL filing of the suit, the courts can reattach despite any contractual liability predisposed of via the sale/trade contract.

Once you have pending litigation, your assets (in Fl) are basically frozen. If you achieve higher worth, it can not be added.....unless.....and I will get to that in a moment.....

Your net worth (as LLC, Inc) is liable for seizure if judgement is awarded.

Back to above.....

If......IF......plaintiff can prove gross negligence AND/OR INTENT to defraud, the corp. shield will no longer protect the defendant from having personal assets attached/seized/garnished.

Bad news is that it is expensive to get there.....trust me.

For those familiar with my case, I am at the crossroads of accepting a settlement offer from the insurance co that represents tbus port Charlotte, or pressing the case to a jury trial and adding in gross negligence....punitive damages....attaching the owners personal net worth.

Not sure how many judgments this makes, but "several" comes to mind. It would amaze me if OSO deleted the threads not only spelling out the various cases, but the ones where Pantera replied to. Those were priceless, and very informative. I'm sure many have them saved in PDF form. Like most, I'm in disbelief that this kind of outfit is able to just switch names and keep doing the same thing over and over.

More amazing than Pantera defending themselves.....the OSO members defending them. Wow, just wow!

History and loyalty before character and morals. Happens to the best of them. Pretty sad family legacy though, especially given the personal posts by them. I would have felt bad for them, but they continued to do it, and deny it, for a very long time. At that point, most would conclude it's not only premeditated, but habitual character. They're crooks, plain and simple.

The argument about producing great boats is not only shallow, but embarrassing. The sad part is, they did produce great boats.

In the end, the silence of their cheerleaders is deafening, and so were their lack of orders. Nobody's that stupid anymore right?

OK, so why is this forum helping Pantera to screw people? We should all post on Pantera's fb page. I did under the 41' thread. My name is Carl C. That poofed thread had a ton of good info to help protect anyone looking to do business with these crooks.

So you sent him his $127,000 dollar check. Some how I doubt that. Guessing by your track record your just buying yourself more time. Can't even believe you can come on here and post. Go back under your rock. You are a thief and will always be!!

if an agreement was reached there would be no court order,sorry but you have NO credability.

Would you mind replying with some answers as to why Berk was put in this situation to begin with? Why were the deadlines not met? Could you give your buying public some answers instead of leaving everything in a shroud of secrecy?

I have no dog in this fight and no ill intent with my post. I generally make it a rule to stay put of these threads when possible. Trust me when I say this, there are people like myself that would love to have an honest answer. If its money, then say it, don't deny it. Not one person, myself included, is perfect on this forum. We all screw up.

I see this as an opportunity to come clean and give your fans the truth. Many like me just sit back and read this stuff never saying a word. These are the people that see these threads prior to them being deleted and take note.

I promise I will not attack you or your company for simply replying. It's not in my DNA.

I have admired your products for years from afar. I've seen the performance and build quality that comes from your hard work. Give us the answers we deserve. It will be much easier this way, trust me.

Just wondering why you say an agreement was reached between Berk and you " PANTERA " when in fact the agreement was reached after months in court by a judge who awarded Berk $127k... Perhaps saying an agrrement was reached with Berk his attorneys and the judge would be more factual and honest, you make it sound like you yourself agreed to pay Berk back money's owed to him without any court interference !

I'm thinking your attorneys asked that any thread discussing this dishonest dealing be taken down so that future buisness would not be impacted, " like it never happened " and guessing you knowing how hard it is to achieve the recovery of any judgment would see how this would work in your favor. If Berk did request the threads to be removed it was only to receive his judgment! He has made it clear in others threads that the deletion of these was wrong and should have never been removed.

I've been following this thread since day one in the background and have remained silent, i believe we as a boating community all have a dog in this fight, maybe not financially, but deffinatly morally !

No deal that included staying silent on OSO.

If memory series me correctly. somewhere around XXk was offered to buy out his interest in sos and walk away. This would have left you with a vested financial interest in that site. AS such, you would not have been on a competitors site blasting away.

Im not defending CS nor attacking you, only saying that being hypocritical in your zeal to expose can diminishes ones credibility. Which would be counter productive as it seams your motivation is to foster credibility, accountability and respectability in the sport.

I've never seen so many threads from a manufacturer get deleted as this one. And I'm talking from waaayyy back when the flag waver moderators deleted many informative threads, and I mean a bunch of them.

I agree. Don't understand why a boating forum will remove all the threads that should be left up as a FWIW warning to prospective buyers so they may make a decision with what I would call important info. Otherwise, chit can the Beware section. Just who is OSO protecting?

Or it could be that he just does not want any one else sucked into buying a boat, putting a large deposit down and waiting years to get it,if they even do.

It appears Berk's thread was removed sometime after the case was settled on 9-16-13.
Purely speculation on my part, but both parties may have requested to have it removed. I truly have no idea though.

When looking at both of the court record documents between Berk and Pantera, one document shows that a confidential agreement was reached in mediation.
The other document shows an agreed final judgement of 127k. Those were recorded a few days apart, but both are dated 9-16-13.

Your luck in screwing over people seems to have gone on for decades. Franklly I'm amazed that some disgruntled (mad as hell) customer hasn't put a bullet in you "yet". Some piece of trash, like yourself with no morals or values, like yourself, will put an end to your scams! Keep pushing your luck sport.
